03-10-97PROCEEDINGS OF THE CITY COUNCIL Approved 3-24-97 CITY OF JANESVILLE, WISCONSIN REGULAR MEETING March 10, 1997 VOL. 47 NO. 35 Regular meeting of the City Council of the City of Janesville held in the Municipal Building on March 10, 1997. The meeting was called to order by Council President Schneider. Present: Council President Schneider, Councilmembers Stehura, Brien, O'Leary, Cullen, Noll and Westphal. Councilmember Brien led the Council in the Pledge of Allegiance. ~ENDA Minutes of the regular meeting held February 24, 1997. Minutes of the closed session held February 24, 1997. Licenses; and recommendations of the Alcohol License Advisory Committee. Action on a motion to approve final Certified Survey Map #97008-C, a one lot survey of land located in the 2100 block of South River Road. Council President Schneider stated the consent agenda would be approved if there were no objections. There were no objections. (All applications of licenses are on file in the office of the City Clerk and are incorporated by reference herein and may be examined upon request at all reasonable times.) OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. There were none. 2. A proposed ordinance rezoning property located at 1516 Plainfield Avenue from B2 to B4 received its second reading and public hearing. No one appeared for the public hearing. Councilmember Noll moved to adopt said ordinance, seconded by Councilmember Brien and passed unanimously. (File Ordinance No. 97-1100) 3. A proposed ordinance amending the City's sidewalk ordinance received its second reading and public hearing. Luella Shackelford, 451 South Lexington Drive, stated her opposition to the sidewalk ordinance and associated policies. Councilmember O'Leary moved to adopt said ordinance, seconded by Councilmember Westphal and passed unanimously. Councilmember Cullen moved to approve City Council Policy #70 for sidewalks incorporating the ordinance changes, seconded by Councilmember Noll and passed unanimously. (File Revised Ordinance No. 96-1078) 4. Public hearing and action on a final resolution for Public Works Program #1 - 1997. Dale Berlin, 422 Park Avenue, and Albert Kath, 452 S. Randall Aw~nue, stated their opposition to the street assessment levied against ]Faith Bible Church. Jack Schooley, 2008 North Lexington Drive, stated his opposition to the curb and gutter assessment levied against his property. Gale Copland, 1310 MacArthur Drive, stated his opposition to the curb and 9//tter assessment levied against his property. Councilmember Stehura moved to adopt said resolution and to incorporate the Administration's recommendations for a ten-year non-use deferment in Category I for Vic Little on Rockshire Drive and the Elmer Frank property on Milton Avenue and Lexus Lane; in Category III for Don Marklein on Crabapple Lane and Austin Road; and in Category V for Tim Weber on Widgeon Drive, seconded by Councilmember Cullen. Councilmember Stehura moved to amend the motion by deleting from Category VII Mole Avenue from North Oakhill Avenue to Church Street and West Memorial from North Oakhill Avenue to North Marion Avenue, seconded by Councilmember Cullen and passed unanimously. Councilmember Westphal moved to amend the motion by granting Faith Bible Church a ten-year non-use deferment, a five-year payment plan with the interest rate based on the City's current borrowing rate and to change the assessment from 350 feet to 236 feet, seconded by Councilmember Noll and passed unanimously. The Council voted on the main motion and it passed unanimously. (File Resolution No. 97-2164) 5. Councilmember Noll moved to reject all bids for Contract M (Street Lighting) and to award the following Public Works contracts: A. Sewer & Water R.T. Fox Contractors, Inc. $967,055..00 B. Sidewalk Replacement Johnson Brothers Construction $162,350.00 II The motion was seconded by Councilmember Cullen and passed unanimously. 6. Proposed ordinances designating Tripp Road from Afton Road to Hayner Road as a connecting arterial street (97-1102), designating North Franklin Street from Mineral Point Avenue to North Washington Street as a through arterial street. (97-1103) and repealing the ordinance prohibiting westbound to southbound left turns at the intersection of Oakland ~enue and South Main Street (97-1104) received their second readings and public hearings. No one appeared for the public hearings. Councilmember O'Leary moved to adopt said ordinances, seconded by Councilmember Noll and passed unanimously. (File Ordinance No. 97-1102, 97-1103 and 97-1104) 1. A proposed resolution acknowledging the Council's review of the 1996 Compliance Maintenance Annual Report of the Wastewater Treatment Plant. Councilmember Noll moved to adopt said resolution, seconded by Councilmember Stehura and passed unanimously. (File Resolution No. 97- 2145) 2. A proposed resolution authorizing a State sponsored local road improvement project on East Memorial Drive from Harding Street to Eisenhower Avenue. Councilmember Stehura moved to adopt said resolution, seconded by Councilmember Noll and passed unanimously. (File Resolution No. 97-2163) 3. A proposed ordinance rezoning property located within the 1700.-1900 blocks of South River Road from Ri and Conservancy to R3 and R3M was introduced, referred to the Plan Commission and scheduled for public hearing on April 14, 1997. (File Ordinance No. 97-1105) 4. A proposed ordinance amending the Zoning Ordinance text to allow music and dance schools within the O1 district was introduced, referred to the Plan Commission and scheduled for public hearing on April 14, 1997. (File Ordinance No. 97-1106) 5. A proposed ordinance annexing property located within the 3300 10lock of East Rotamer Road was introduced and scheduled for public hearing on April 14, 1997. (File Ordinance No. 97-1107) 6. A proposed ordinance zoning land within the 3300 block of East Rotamer Road to Ri upon annexation was introduced, referred to the Plan Commission and scheduled for public hearing on April 14, 1997. (File Ordinance No. 97-1108) 7. A proposed ordinance annexing a parcel located within the 500 block of USH 14 was introduced and scheduled for public hearing on April 14, 11997. (File Ordinance No. 97-1109) 8. A proposed ordinance zoning a parcel located within the 500 block of USH 14 to Ri upon annexation was introduced, referred to the Plan Commission and scheduled for public hearing on April 14, 1997. (File Ordinance No. 97-1110) 9. Matters not on the agenda. Councilmember Cullen commended the Administration on the first City newsletter that was distributed to the community. Councilmember O'Leary alerted the Administration and the City Council that the parking ramp is deteriorating rapidly and cement chunks are falling from the wall onto the floor. Council President Schneider scheduled an organizational meeting for April 15, 1997 at 6:00 p.m. 10. Councilmember Noll moved to convene into closed session pursuant to Wisconsin Statute Section 19.85(1) (e), for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, seconded by Councilmember Westphal and passed unanimously.
