09-11-1995PROCEEDINGS OF THE CITY COUNCIL APPROVED 09-25-95 CITY OF JANESVILLE, WISCONSIN REGULAR MEETING September 11, 1995 VOL. 46 NO. 13 Regular meeting of the City Council of the City of Janesville held in the Municipal Building, September 11, 1995. The meeting was called to order by Council President Heitzman. Present: Council President Heitzman, Councilmembers Stehura, Brien, Schnieder, O'Leary and Thomas. Absent: Councilmember Noll. Councilmember Brien led the Council in the Pledge of Allegiance. CONSENT AGENDA Minutes of the special meeting held August 21, 1995. Minutes of the regular meeting held August 28, 1995. Minutes of the closed session held August 28, 1995. Licenses; and recommendations of the Alcohol License Advisory Committee. Certified Survey Map 95048-C, one lot on Bell Street. Council President Heitzman stated if there were no objections the consent agenda would be approved. There were no objections. (Ail applications of licenses are on file in the office of the City Clerk and are incorporated by reference herein and may be examined upon request at all reasonable times.) OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. There were none. 2. Public hearing and action on final resolution for Public Works Program #3-1995. No one appeared for the public hearing. Councilmember O'Leary moved to adopt said resolution with the following changes: 1. Delete Timber Lane from West Memorial Drive to the cul du sac from Section I and delete easement from Timber Lane to Hickory Meadow Drive from Section II. 2. Grant a ten year non-use deferment to Sinnissippi Partnership for improvements on Midvale Drive, to Webco for improvements on Widgeon Drive, to GarMar for improvements on Westminster Drive and to James Campbell for improvements on Midvale and Green Valley Drive. The motion was seconded by Councilmember Brien and passed unanimously. (File Resolution No. 95-1959) 3. Award of contracts W (sewer and water), X (Riverside Park Boat Ramp) and Z (Traffic Signal Underground System Pontiac Drive and Mt. Zion Avenue) of the Public Works Program #3-1995. Councilmember O'Leary moved to award contracts W ($703,590.00) and Z ($24,099.25) and to reject contract X, seconded by Councilmember Thomas and passed unanimously. 4. A proposed ordinance amending the zoning code to allow manufactured homes in all residence districts received its second reading and public hearing. No one appeared for the public hearing. Councilmember O'Leary moved to adopt revised ordinance 95-1006. Councilmember Stehura moved to amend the motion by changing Section III (11) (b) to, "minimum floor area excluding the garage, decks, porches, and basement: 800 square feet heated living space" and Section IV (11) (b) tc, "minimum floor area excluding the garage, decks, porches, and basement: 800 square feet and heated living space," seconded by Councilmember Thomas and passed by the following vote: Aye: Council President Heitzman, Councilmembers Stehura, Brien, O'Leary and Thomas. Absent: Councilmember Schneider. Council voted on the main motion and it passed by the following vote: Aye: Council President Heitzman, Councilmembers Stehura, Brien, O'Leary and Thomas. Absent: Councilmember Schnieder. (File Revised Ordinance 95-1006) 5-8. Council President Heitzman combined the second readings and public hearings for proposed ordinances annexing (95-1007) and zoning (95-1008) a portion of East Rotamer Road in the 3300 block and ordinances annexing (95-1004) and zoning (95-1005) property located at 3338 East Rotamer Road. No one appeared for the public hearing. Councilmember O'Leary moved, to adopt all ordinances, seconded by Councilmember Brien and passed unanimously. (File Ordinance 95-1007, 95-1008, 95-1004 and 95-1005) NEW BUSINESS 1. A proposed resolution authorizing the lease of City owned land on Center Avenue north of Rock River. Councilmember O'Leary moved to adopt said resolution, seconded by Councilmember Schneider and passed unanimously. (File Resolution No. 95-1960) 2. A proposed resolution authorizing a supplemental appropriation to install traffic signals at Pontiac Drive and Pontiac Place. Council President Heitzman allowed Ramon Ruiz to address the Council on traffic signals ordered in at this location. Mr. Ruiz stated that all citizens will benefit from the traffic signals and a portion of the cost should not be assessed to the surrounding businesses. Councilmember Schneider moved to adopt said resolution, seconded by Councilmember O'Leary and passed unanimously. (File Resolution No. 95-1956) 3. A proposed resolution authorizing a supplemental appropriation to install 44 street lights. Councilmember Brien moved to adopt said resolution, seconded by Councilmember Thomas and passed unanimously. (File Resolution No. 95-1957) 4. A proposed resolution authorizing a supplemental appropriation to provide funds to repair the stairs at City Hall entrance plaza. Councilmember Brien moved to adopt said resolution, seconded by Councilmember Schneider and passed unanimously. (File Resolution No. 95-1958) 5. A proposed resolution vacating a portion of an alley between West Court and West Milwaukee Streets was referred to the Plan Commission and scheduled for public hearing on October 23, 1995. (File Resolution No. 95-1955) 6. A proposed ordinance rezoning 2911 Carrousel Lane from Ri to R3 was introduced, referred to the Plan Commission and scheduled for public hearing on October 9, 1995. (File Ordinance No 95-1009) 7. A proposed ordinance annexing a portion of street right of way for Drexel Drive south of MLlwaukee Street and east of U.S. Hwy 14 was introduced and scheduled for public hearing on October 9, 1995. (File Ordinance No. 95-1010) 8. A proposed ordinance zoning a portion of street right of way for Drexel Drive south of Milwaukee Street and east of U.S. Hwy 14 was introduced, referred to the Plan Commission and scheduled for public hearing on October 9, 1995. (File Ordinance No. 95-1011) 9. A proposed ordinance annexing property located at 3532 East Rotamer Road was introduced and scheduled for public hearing on October 9, 1995. (File Ordinance No. 95-1012) 10. A proposed ordinance zoning property located at 3532 East Rotamer Road was introduced, referred to the Plan Commission and scheduled for public hearing on October 9, 1995. (File Ordinance No. 95-1013) 11. A proposed ordinance annexing property occupied by Morgan Corporation located on Morgan Way was introduced and scheduled for public hearing on October 9, 1995. (File Ordinance No. 95-1014) 12. A proposed ordinance zoning property occupied by Morgan Corporation located on Morgan Way was introduced, referred to the Plan Commission and scheduled for public hearing on October 9, 1995. (File Ordinance No. 95-1015) 13. Matters not on the agenda. Councilmember Brien requested the City Clerk to read the proclamation for the "Day of Caring" which recognized United Way. In addition, he requested that the administration fix three street lights in Monterey Park. Councilmember Stehura requested additional information about Sharky's operations as reported in the Alcohol License Advisory Committee minutes. Police Chief Brunner stated that OC spray and a hand gun was kept on the premise in an office cabinet. The police will monitor this situation.
