03-20-1995SPROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN SPECIAL MEETING March 20, 1995 APPROVED 4-10-95 Vol. 45 No. 32 Special meeting of the City Council of the City of Janesville held in the Municipal Building, at 7:00 p.m. on March 20, 1995. The meeting was called to order by Council President Noll. Present: Council President Noll, Councilmembers Stehura, Heitzman, Brien, O'Leary, Schneider and Thomas (arrived at 7:03 p.m.). Council President Noll stated that this was a revocation/suspension hearing of a Class B Combined Fermented Malt Beverage and Intoxicating Liquor Alcohol Beverage License granted and issued to one Sami Dalip, licensee and sole proprietor, d/b/a Regency Pub, a/k/a the London Bar, for the premises located at 121 East Milwaukee Street, Janesville, Wisconsin. She requested Sami Dalip and/or anyone appearing in his behalf, that was present, to sit in the front row and participate in the hearing. No one in the audience responded to the request. Council President Noll requested the complainant, Police Chief George Brunner and his attorney, Dick Hemming, to come forward and participate in the hearing. While the Council waited for Mr. Dalip, or anyone appearing in his behalf, to make an appearance before the Council, she requested Attorney Hemming to present the evidence prepared for this meeting. Attorney Hemming stated the London/Regency Pub has violated Sections 125.68 and 125.07 of the Wisconsin Statutes, and/or regulations of Chapters 5.06 and 5.40 of the Code of General Ordinances of the City of Janesville, all of which were properly enacted, pursuant to State Statutes 125.10 and Chapter 15.80 of the Code of General Ordinances of the City of Janesville. Further, that the premises has not been used for more than 90 days, and has, therefore, been abandoned within the meaning of Janesville General Ordinance 5.06.180. Further, the licensee keeps or maintains a disorderly riotous, indecent or improper house, and has failed to maintain an orderly license establishment and has not demonstrated the character and fitness to hold a Class B alcohol license. In addition, Attorney Hemming presented into evidence Exhibit A, the complaint dated March 13, 1995, the summons: dated March 13, 1995 and the Affidavit of Service dated March 13, 1995 and the accompanying attachments; Exhibit B, the compendium and supporting documents for London/Regency Pub liquor license revocation; Exhibit C, the police incident reports from 1992, 1993 and 1994 for the London/Regency Pub; and Exhibit D, police incidents at alcohol license establishments in the downtown area for 1992, 1993 and 1994. In summation, Attorney Hemming stated that the record speaks for itself and that the Common Council must decide what action to take on the London/Regency Pub liquor license. For the record, Council President Noll noted that it was 7:27 p.m., and Sami Dalip, nor anyone appearing on his behalf, had made an appearance before the City Council. Councilmember Brien moved to find the facts alleged in the Police Chief's complaint sufficient and true, seconded by Councilmember Schneider and passed unanimously. Councilmember Brien moved to revoke Sami Dalip, licensee and sole proprietor, d/b/a Regency Pub, a/k/a The London Bar, for the premises located at 121 East Milwaukee Street, Janesville, Wisconsin, seconded by Councilmember Schneider and passed unanimously.
