A special meeting of the City Council of the City of Janesville,
held in the Municipal Building, January 30, 1995.
The meeting was called to order by Council President Noll.
Present: Council President Ncll, Councilmembers Stehura, Heitzman,
Brien, O'Leary, Schneider, and Thomas.
Councilmember Stehura led the Council in the Pledge of Allegiance.
1. Requests and comments from the public on matters which can be
affected by Council action.
Tom Wolfe, 501 Stafford Road, asked Council to approve the proposed
Leach Farm annexation and TIF XIV District. Bill Mears, 2518 West
Memorial Drive, president of and representing Forward Janesville,
urged Council to support the proposed TIF XIV District. Mike
Hodges, 57 Jackman Street, asked Council to consider removing the
overnight parking restriction on the upper Courtlnouse parking lot
when a snow emergency is declared. Mr. Hodges also asked that the
flag in front of the Municipal Building be lit at night.
2. Review and action on Council parliamentary procedures including
reconsideration. Council President Noll announced this item would
be taken up later in the meeting.
3. Proposed ordinances annexing and zoning property located east of
Wright Road and north of State Highway 11 received their second
readings and public hearing. No one appeared for the hearing.
Councilmember O'Leary moved, to adopt said ordinances, seconded by
Councilmember Schneider and passed with the following vote: Aye:
Council President Noll, Councilmembers Heitzman, Brien, O'Leary,
Schneider. Nay: Councilmember Thomas. Pass: Councilmember Stehura.

5. A proposed resolution approving the project plan for TIF
District XIV. (File Resolution No. 94-1855)
6. A proposed resolution authorizing the City Manager to enter into
an offer to purchase agreement with Ed Leach Farms, Inc. (File
Resolution No. 94-1856)
7. A proposed resolution authorizing the City Manager to enter into
a TIF development agreement with Lab Safety Supply, Inc. on 48 acre
parcel in TIF XIV. (File Resolution No. 94-1857)
Councilmember Heitzman stated for the record that this proposed TIF
District was examined very carefully due to its large expenditure
plan.
Councilmember O'Leary moved to adopt said resolutions with an
addendum to File Resolution. No. 94-1856 to require the Leaches to
exercise their option to purchase alternate farmland within 7
years, seconded by Councilmember Schneider and passed with the
following vote: Aye: Council President Noll, Councilmembers
Heitzman, Brien, O'Leary, Schneider. Nay: Counoilmember Thomas.
Pass: Councilmember Stehura. (File Resolution Nos. 94-1855, 94-
1856, & 94-1857)
8. A proposed resolution authorizing the City Manager to enter into
a TIF development agreement with Lab Safety Supply, Inc. on 22.7
acre parcel in TIF District X.
Councilmember O'Leary moved, to adopt said resolution, seconded by
Councilmember Schneider.
Councilmember O'Leary moved to amend said resolution by changing
the date in the Option to Purchase and Agreement to Sell, Section
I (C) (2) to December 31, 1997, seconded by Councilmember Heitzman
and passed with the following vote: Aye: Council President Noll,
Councilmembers Heitzman, Brien, O'Leary. Nay: Councilmembers
Schneider and Thomas. Pass: Councilmember Stehura.
Council then voted on the motion as amended and passed with the
following vote: Aye: Council President Noll, Councilmembers
Heitzman, Brien, O'Leary, Schneider and Thomas. Pass: Councilmember

Council then took up Item 2: Review and action on Council
parliamentary procedures including reconsideration.
Councilmember O'Leary moved to direct the Administration to prepare
a proposed ordinance to address reconsideration and rescinding
procedures, and seconded by Councilmember Heitzman and passed
unanimously.
9. Matters not on the agenda.
The City Manager advised Council that Mercy Hospital filed a claim
on January 30, 1995 to reccver unlawful taxes.
10. Closed Session.
Councilmember Schneider moved to convene into closed session
pursuant to Wisconsin Statute section 19.85 (1) (c), for the purpose
of considering the performance of the City Manager, seconded by
Councilmember Heitzman and passed unanimously.
There being no further business, Council convened into closed
session at 8:50 p.m.
