Regular meeting of the City Council of the City of Janesville, held
in the Municipal Building, 5 October 1992 at 7:00 p.m.
The meeting was called to order by Council President Brien.
Present: Council President Brien, Councilmembers Heitzman, O'Leary,
Noll, Stehura, Schneider, and Thomas.
Councilmember Schneider led the Council in the Pledge of
Allegiance.
CONSENT AGENDA
Minutes of the regular meeting held 8 September 1992.
Minutes of the special meeting held 10 September 1992.
Minutes of the regular meeting held 21 September 1992.
Licenses and recommendations of the Alcohol License Advisory
Committee.
Waiver of a special assessment procedure for sewer and water in the
knolls of Wuthering Hills Subdivision.
Council President Brien stated that if there were no objections,
the consent agenda would be approved. There were no objections.
Action on a proposed resolution and commendation of Robert
Johnson's 14 years of service to the City of Janesville.
Councilmember Schneider moved to adopt said resolution, seconded by
Councilmember Stehura and passed unanimously. (File Resolution No.

OLD BUSINESS
1. Requests and comments for the public on matters which can be
affected by Council action. There were none.
Council President Brien stated that old business #2, #3, #5, and #6
would be postponed until after 7:30 p.m.
4. A proposed ordinance designating Parker Place as one way
southbound from East Wall Street to East Milwaukee Street was given
its second reading and public hearing. No one appeared for the
public hearing. Councilmember Schneider moved to adopt said
ordinance, seconded by Councilmember Noll and passed unanimously.

7. A proposed resolution reviewing the goals and objectives and
providing a sunset provision for the Business Improvement District.
Councilmember Noll moved to adopt said resolution, seconded by
Councilmember Heitzman and passed unanimously. (File Resolution

NEW BUSINESS
1. Councilmember O'Leary moved to approve the City Manager's
appointment of Noble Rose to the Historic Commission, seconded by
Councilmember Noll and passed unanimously.'
2. Francis McGee, Vice President of the Library Board and Karen
Krueger, Library Director, presented the 1993 Library budget to the
council. The council placed the budget on file for further review.
3. A proposed ordinance deannexing property located west of Afton
Road South of Rockport Park was introduced and scheduled for public
hearing on 19 October 1992. (File Ordinance No. 92-811)
OLD BUSINESS
2. A proposed ordinance annexing property located at the southeast
corner of East Milwaukee Street and highway 14 was given its second
reading and public hearing.
The following individuals spoke in favor of the proposed ordinance:
Attorney Richard Hemming representing Frank Silha, Attorney Bruce
Briney representing MCI.
The following individuals spoke in opposition to the proposed
ordinance: Donald Branz, 336 South Harmony; Leo Johnson, 1110 Hwy.
14 East; Attorney Fred Wesner representing Touson Enterprises; Don
Donohue, 601 South Washington; and Attorney Bob Elliott
representing Maurice Adams.
Councilmember Noll moved to postpone action on this ordinance until
19 October 1992, seconded by Councilmember Heitzman. The motion
was then withdrawn by the maker and the seconder.
Councilmember Noll moved to annex 28 acres of the Silha property,
the Hirsch property, and the Campbell property and withdrew her
motion. Councilmember Schneider moved to adopt ordinance 92-807
and to amend the legal description to only include 28 acres of the
Silha property, the Hirsch property, and the Campbell property,
seconded by Councilmember Thomas and passed unanimously.
Councilmember Stehura moved to accept the Silha annexation
agreement, seconded by Councilmember Schneider and passed
unanimously. (File Ordinance No. 92-807)
3. A proposed ordinance establishing the zoning classification of
land located at the southeast corner of East Milwaukee Street and
Hwy. 14 was given its second reading and public hearing. No one
appeared for the public hearing. Councilmember Schneider moved to
adopt said ordinance and amend the legal description to coincide
with the annexation ordinance 92-807, seconded by Councilmember
Thomas and passed unanimously. (File Ordinance No. 92-808)
5. A proposed ordinance rezoning property located at 117 Oakland
Avenue from R2 to 02 was given its second reading and public
hearing. No one appeared for the public hearing. Councilmember
Schneider moved to deny said ordinance, seconded by Councilmember
Stehura and passed unanimously. (File Ordinance No. 92-805)
6. A proposed ordinance rezoning a portion of the property located
at 2116 Center Avenue from B3 to R3 was given its second reading
and public hearing.
The following individuals spoke in opposition to this ordinance:
William Sampson, 2134 South Terrace; James Dobson, 2126 South
Terrace; and Bob Geisler, 2027 South Terrace. Councilmember
Schneider moved to deny said ordinance, seconded by Councilmember
Thomas and failed by the following vote: Aye: Councilmembers
Schneider and Thomas. Nay: Council President Brien,
Councilmembers Heitzman, O'Leary, Noll, and Stehura.
Councilmember Stehura moved to postpone action and schedule another
public hearing on this ordinance for 2 November 1992, seconded by
Councilmember Heitzman and passed by the following vote: Aye:
Council President Brien, Councilmembers Heitzman, O~Leary, Noll,
Stehura, and Thomas. Nay: Councilmember Schneider. (File

NEW BUSINESS
4. Matters not on the agenda. There were none.
5. Councilmember Noll moved to convene into closed session
pursuant to Wisconsin Statute Section 19.85(1) (e) for the purpose
of deliberating or negotiating the purchasing of public properties
the investing of public funds or conducting other specified public
business whenever competitive or bargaining reasons require a
closed session, seconded by Councilmember Heitzman and passed by
the following vote: Aye: Council President Brien, Councilmembers
Heitzman, O'Leary, Noll, Stehura, and Thomas. Nay: Councilmember
Schneider.
There being no further business, the Council convened into closed
session at 9:18 p.m.
