09-20-93PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING September 20, 1993 APPROVED 10-4-93 Vol. 44 No. 13 Regular meeting of the City Council of the City of Janesville, held in the Municipal Building, September 20, 1993. The meeting was called to order by Council President O'Leary. Present: Council President O'Leary, Councilmembers Stehura, Heitzman, Schneider, Brien and Thomas. Absent: Councilmember Noll CONSENT AGENDA: Minutes of the regular meeting held September 7, 1993. Minutes of the closed session held September 7, 1993. Licenses; and recommendations of the Alcohol License Advisory Committee. Final Certified Survey Map 93035-C, 2 lots located at the southeast corner of State St. and South Oakhill Av. Authorization by the City Council to deny a liability claim for Darlene Brown. Council President O'Leary stated that if there were no objections, the minutes, Final Certified Survey Map 93035-C and the liability claim would be approved. There were no objections. Councilmember Brien moved to approve all licenses on the license agenda, seconded by Councilmember Heitzman and passed unanimously. (All applications of licenses are on file in the office of the City Clerk and are incorporated by reference herein and may be examined upon request at all reasonable times.) OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. There were none. 2. Public hearing and final resolution for Public Works Program #3 - 1993. No one appeared for the public hearing. Councilmember Schneider moved to adopt said resolution, seconded by Councilmember Heitzman and passed unanimously. (File Resolution No. 93-1654) 3. Public hearing on public access for Cable TV. Carl Balson, director of the Beloit Access Television, explained how the City of Beloit handles public access on Cable TV. The City has a contractual agreement with Beloit College to run public access. The City of Beloit paid a one time start-up fee of $50,000 to purchase equipment and pays an annual fee of $20,000 for operations. The college pays the salary of the Director of Beloit Access Television and pays all overhead costs for the studio. The studio is staffed by students enrolled in broadcast journalism classes, who are not paid for their time, and a paid part time staff. Jon Jorstad and Vern Morse, representing Local 95, stated their support for public access and would be interested in showing prerecorded videos and producing their own videos. Dean Jane Crisler, UW Rock County, stated her interest in exploring the feasibility of having a public access studio at the university. It would be her intention to use the studio in conjunction with developing a broadcasting journalism curriculum. Councilmember Brien moved to refer this matter to the Cable Advisory Committee, seconded by Councilmember Heitzman. Councilmember Stehura moved to amend the motion by directing the Cable Advisory Committee to explore an option that includes a cooperative venture with another party/agency, seconded by Councilmember Heitzman and passed unanimously. Council voted on the main motion and it passed unanimously. 4. A proposed ordinance amending the 01 zoning district to allow photographic studios was given its second reading and public hearing. No one appeared for the public hearing. Councilmember Brien moved to adopt said ordinance, seconded by Councilmember Schneider and passed unanimously. (File Ordinance No. 93-885) 5. A proposed ordinance rezoning property at the 3000 block of Palmer Drive from M1 to R3 was given its second reading and public hearing. Attorney Bob Consigny, representing the property owner, spoke in favor of this ordinance. Councilmember Schneider moved to adopt said ordinance, seconded by Councilmember Brien and passed unanimously. (File Ordinance No. 93-881) 6 & 7. Council President O'Leary combined the second readings and public hearings for proposed ordinances annexing property at 3401 Mineral Point Avenue (Ord. No. 93-882) and the zoning of said property (Ord. No. 93-883). No one appeared for the public hearing. Councilmember Schneider moved to adopt both ordinances, seconded by Councilmember Heitzman and passed unanimously. No. 93-882 and 93-883) (File Ordinances 8. A proposed ordinance amending the list of streets required to yield to other designated streets by adding Nantucket Dr. yields to Alpine Dr.; and South Huron Dr. yields to Mt. Vernon Av., was given its second reading and public hearing. Randy Love, 55 South Huron, stated his support for traffic control at the intersection of South Huron Dr. and Mt. Vernon. It is his opinion that a stop sign should be installed instead of a yield sign, because of the home business that is located near the intersection and the pine tree on the SE corner, blocking the vision triangle. Councilmember Brien moved to adopt said ordinance and place on a future agenda, a new ordinance for stop sign at the intersection of South Huron Dr. and Mt. Vernon Av., seconded by Councilmember Stehura and passed unanimously. (File Ordinance No. 93-887) 9. A proposed ordinance amending the list of streets fixing a maximum speed limit by adding West Rotamer Rd. from Whitney St. to the north city limits; and Ruger Av. from South Wright Rd. to USH 14, was given its second reading and public hearing. Councilmember Brien moved to adopt said ordinance, seconded by Councilmember Schneider and passed unanimously. (File Ordinance No. 93-888) NEW BUSINESS 1. A proposed resolution releasing a street reservation along Chadswyck Dr. between Rockshire Dr. and Highway 14. Councilmember Schneider moved to adopt said resolution, seconded by Councilmember Heitzman and passed unanimously. (File Resolution No. 93-1652) 2. A proposed resolution converting the adjusted interest rate to a fixed rate on the City of Janesville's Wisconsin Pollution Control Revenue Bond for General Motors Corporation. Councilmember O'Leary moved to adopt said resolution, seconded by Councilmember Heitzman and passed unanimously. (File Resolution No. 93-1653) 3. A proposed ordinance amending the Janesville General Ordinance 5.06.040 B to eliminate distance measurement formula for liquor establishments, and to add licensed youth entertainment centers as a 300 feet minimum distance requirement, was introduced and scheduled for public hearing on October 4, 1993. Councilmember Stehura requested additional information from the administration on existing alcohol establishments that may be within this 300 ft. range, and what is meant by the language "this subsection shall not apply to any premises licensed continuously since June 30, 1947." (File Ordinance No. 93-890) 4. A proposed ordinance rezoning Commons South Park from Conservancy to R1 was introduced, referred to the Plan Commission and scheduled for public hearing on October 18, 1993. (File Ordinance No. 93-891) 5. A proposed ordinance amending provisions in the zoning and building code relating to accessory buildings, off street parking, medium density residential districts, and home occupations and garage sales, was introduced, referred to the Plan Commission and scheduled for public hearing on October 18, 1993. Councilmember Heitzman requested that the administration send a copy of this proposed ordinance to the South Central Wisconsin Builders Association, to allow them sufficient time to review this proposal. (File Ordinance No. 93-889) 6. Matters not on the agenda. Councilmember Schneider moved to award the sewer and water contract for Program #3-1993 to R. T. Fox Contractors, Inc. in the amount of $1,193,345.00, seconded by Councilmember Brien and passed unanimously. Councilmember Brien moved to reject the bid for the Lions Beach roof, and requested that it be rebid on the spring public works program #1-1994, seconded by Councilmember Schneider and passed unanimously. Council President O'Leary requested that at the next Transportation Committee meeting, the committee address the feasibility of having a crossing guard at the intersection of Milton Av. and Memorial Dr. Also, he requested that the administration check East Milwaukee St. for a sink hole located between Main St. and the Milwaukee St. Bridge. Councilmember Schneider requested that the administration check the new pavement on Memorial Dr., for chunks of pavement breaking away from the street.
