09-07-93PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING September 7, 1993 VOL. 44 NO. 12 APPROVED 9-20-93 Regular meeting of the City Council of the City of Janesville, held in the Municipal Building, September 7, 1993. The meeting was called to order by Council President O'Leary. Present: Council President O'Leary, Councilmembers Stehura, Heitzman, Noll, Schneider, and Brien. Absent: Councilmember Thomas. Councilmember Heitzman led the Council in the Pledge of Allegiance. CONSENT AGENDA Minutes of the regular meeting held August 23, 1993. Minutes of the closed session held August 23, 1993. Licenses; and recommendations of the Alcohol License Committee. Advisory Council President O'Leary stated that if there were no objections, items 1 & 2 of the consent agenda would be approved. There were no objections. Councilmember Stehura moved to approve all recommended licenses, seconded by Councilmember Noll and passed unanimously. Councilmember Stehura moved to deny an original taxi cab drivers license to Tammy Pippin, seconded by Councilmember Noll and passed unanimously. Councilmember Stehura moved to deny a youth entertainment center license to Tracey Torsini, seconded by Councilmember Noll. Tracey Torsini, 6219 Hwy. 51 South, Janesville, WI addressed Council regarding his license application. Council then voted on the motion and passed unanimously. Council President O'Leary and Councilmember Heitzman requested the current liquor ordinance be amended to eliminate building to building measurements for distance requirements. (Ail applications of licenses are on file in the office of the City Clerk and are incorporated by reference herein and may be examined upon request at all reason- able times.) OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. Louis Gage, 326 South Wisconsin Street, president of the Oakhill Cemetery Association, stated his support for proposed ordinance 93- 884 to allow leaf burning in cemeteries. 2. A proposed revised resolution vacating a portion of South Chatham Street between Rockport Road and Riverside Street received its second reading and public hearing. No one appeared. Councilmember Heitzman moved to adopt said revised resolution, seconded by Councilmember Stehura and passed unanimously. (File Revised Resolution No. 93-1637) 3. A proposed ordinance rezoning property at 164 South Franklin Street from B6 to 02 received its second reading and public hearing. No one appeared. Councilmember Noll moved to adopt said ordinance, seconded by Councilmember Heitzman and passed unanimously. (File Ordinance No. 93-880) 4. A proposed ordinance amending Janesville General Ordinance 8.36.030 C. to allow a cemetery to burn leaves on cemetery property received its second reading and public hearing. No one appeared. Councilmember Noll moved to adopt said ordinance, seconded by Councilmember Brien and passed unanimously. (File Ordinance No. 93-884) NEW BUSINESS 1. Action on a proposed transfer of funds from Undesignated Fund Balance to TIF District No. 3 fund. Councilmember Noll moved to authorize the Finance Director to transfer $300,000 from the Undesignated Fund Balance to the TIF District No. 3 fund, seconded by Councilmember Heitzman and passed unanimously. 2. Recommendations of the Transportation Committee: A. A proposed ordinance amending the list of streets required to yield to other designated streets by adding Nantucket Drive yields to Alpine Drive; and South Huron Drive yields to Mt. Vernon Avenue was introduced and scheduled for public hearing on September 20, 1993. (File Ordinance No. 93-887) B. A proposed ordinance fixing a maximum speed limit on certain designated streets by adding West Rotamer Road from Whitney Street to the north city limits; and Ruger Avenue from South Wright Road to USH 14 was introduced and scheduled for public hearing on September 20, 1993. (File Ordinance No. 93-888) 3. A proposed ordinance amending the zoning ordinance to allow amusement establishments within enclosed building as conditional uses within the M2 district was introduced, referred to the Plan Commission and scheduled for public hearing on October 4, 1993. (File Ordinance No. 93-886). 4. Matters not on the agenda. Council President O'Leary thanked the LaborFest Committee for their efforts over the weekend. Councilmember Schneider requested information regarding options to improve the microphone system in the Council Chambers. Councilmember Stehura moved to waive the fee for a provisional operators license to Denise Kingslien, 220 North Palm Street, and place the matter on the next agenda, seconded by Councilmember Brien and passed unanimously. 5. Closed Session Councilmember Brien moved to convene into closed session pursuant to Wisconsin Statute section 19.85 (1) (e), for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, seconded by Councilmember Heitzman and passed unanimously.
