Regular meeting of the City Council of the City of Janesville held in the Municipal building on March
13. 2000.
The meeting was called to order by Council President Stehura. Councilmember Westphal led the
Council in the Pledge of Allegiance.
Present: Council President Stehuro. Councilmembers Westphal. O'Leary (arrived at 7:45 p.m.).
Murphy. Brien. Noll and Schneider.
CONSENT AGENDA
Minutes of the regular meeting of February 28. 2000.
Licenses; and Recommendations of the Alcohol License Advisory Committee.
Action on an application for a Class B Intoxicating Liquor & Fermented Malt Beverage License -
Original. by End of the Line. LLC. 402 W. Delavan Drive
Action on a motion to approve final Certified Survey Map #00007-C. Chris Lloyd. 1 lot on Rockport
Park Drive.
Council President Stehura stated the consent agenda would be approved, with the exception of the End
of the Line. LLC Class B application, if there were no objections. There were no objections.
Council President held a public hearing for the End of the Line application. Jim Halbach. representing
the applicant, requested that the Council allow him to withdraw the application. The following
individuals opposed this application: Beverly Kranz. President of Trico Credit Union; Paulette Steinke.
712 Prairie Avenue. Beloit; Jeff Vano. 2725 Sherwood Drive; Jeff Scoviak. 436 Delavan Drive; and
Para Bart. 960 Industrial Court. Councilmember Brien requested that the letter from Dolores Toebaas
be entered into the record as opposing this application. Councilmember Brien moved to deny the
application for a Class B Intoxicating Liquor & Fermented Malt Beverage License to End of the Line.
LLC. The motion was seconded by Councilmember Noll and it passed unanimously.
OLD BUSINESS
Requests and comments from the public on matters which can be affected by Council action. Jim
Sheppard. 21 N. Main Street, presented a petition to enforce parking regulations for short-term
parking inthe downtown area. Bob Rippberger. 1915 S. Willard Avenue and Wanden Zittlow.
1838 S. Willard Avenue. expressed their concern about excessive speed, loud exhaust noises and
loud car stereos on S. Willard Avenue. They asked for Council's help to address this problem.

Proposed ordinances annexing (2000-5) and zoning (2000-6) property located on Rockport Park
Drive south and adjoining Rockport Park received their second reading and public hearing. No
one spoke. Councilmember Westphal moved to adopt said ordinances, seconded by
Councilmember Schneider. Council President Stehura split the question. Ordinance No. 2000-5
passed by the following vote: Aye: Council President Stehura. Councilmembers Westphal.
Murphy. Brien and Schneider. Nay: Councilmember Noll. Ordinance No. 2000-6 passed
unanimously. (File Ord. Nos. 2000-5 and 2000-6)
The final resolution for Public Works Pro.am #1-2000 received its public hearing. The
following individuals spoke in opposition to the following assessments:

Councilmember O'Leary arrived at 7:45 p.m. Councilmember Schneider moved to adopt said
resolution, seconded by Councilmember Noll. Councilmember Schneider movedto amend the
motion by deleting N. Sumac Drive. seconded by Councilmember Noll and passed by the
following vote: Aye: Council President Stehura. Councilmembers Westphal. Murphy.
O'Leary. Noll and Schneider. Nay: Councilmember Brim. Councilmember Schneider moved
to amend the motion by deleting the Rock County Easement. S. Chatham Street. S. Sumac
Drive. Winnebago Drive and Cherokee Road and approve the 10-year non-use deferments
recommended by the Public Works Committee. The motion was seconded by Councilmember
Noll and it passed unammously. Councilmember Noll moved to amend the motion by requiring
the property owner of land located outside the City on Kline Avenue to pay carrying costs for
deferments. Councilmember Stehura seconded the motion and it failed by the following vote:
Aye: Council President Stehura. Councilmembers O'Leary and Noll. Nay: Councilmembers
Westphal. Murphy. Brien and Schneider. The Council voted on the main motion and it passed
unanimously. Councilmembers Brien and Schneider requested that the Administration prepare
a policy addressing carrying costs for deferred special assessments. (File Res. No. 2000-30)
Action to award the Public Works Contracts. Councilmember Westphal moved to award the
following contracts:

The motion was seconded by Councilmember Murphy and it passed unanimously.
A proposed ordinance rezoning property located within the 4300 block of West Rotamer Road
from O1 to Ri received its second reading and public heating. No one spoke. Councilmember
Noll moved to adopt said ordinance, seconded by Councilmember Schneider. The motion
passed unanimously. (File Ord. No. 2000-8)
City Manager Sheiffer presented information on the City's fiscal situation. He stated that our
State Aids would decrease and our debt service would increase in future years. The impact of
these projections would result in an unacceptable City tax rate. Therefore. he urged the Council
to adopt the proposed room tax ordinance to help lower property taxes.
A proposed resolution authorizing the replacement of the downtown parking garage received
its public hearing. The following individuals spoke: Jack Damrow. 3726 Skyview Drive.
suggested that the City should assess the property owners in this area; Peter Caro. representing
Odd Fellow Lodge. expressed concern on how his Lodge members could access the second floor
of their building. John Holzhuter. representing Forward Janesville. and Ed Pulliam. 313 S.
Harmony. spoke in support of the resolution. Councilmember Westphal moved to adopt said
resolution, seconded by Councilmember O'Leary. The resolution passed by the following vote:
Aye: Council President Stehura. Councilmembers Westphal. Murphy. O 'Leafy. Brien and
Schneider. Nay: Councilmember Noll. (File Res. No. 2000-28)
A proposed ordinance modifying and increasing the room tax received its second reading and
public hearing. Margaret Schaefer. 332 Forest Hills Blvd. representing Microtel and Holiday
Inn Express. reluctantly af~eed to the increase in room tax. Councilmember Westphal moved
to adopt said ordinance, seconded by Councilmember Schneider. The motion passed

NEW BUSINESS
A proposed resolution authorizing the acquisition of the Community Action Pro.am property
located south of Kellogg Avenue. Councilmember O'Leary moved to adopt said resolution.
seconded by Councilmember Schneider. The motion passed unanimously. (File Res. No. 2000-

A proposed resolution approving a TIF Development A~eement and ~anting an option to
purchase an 8.0 acre industrial site in TIF No. 14 (Leach Farm)to Bliss communications. Inc.
Councilmember Schneider moved to adopt said resolution, seconded by Councilmember
O'Leary and it passed by the following vote: Aye: Council President Stehura. Councilmembers
Westphal. Murphy. O'Leary. Brien and Schneider. Nay: Councilmember Noll. (File Res. No.

A proposed ordinance annexing property located at 4004 Lunar Drive was introduced and
scheduled for public hearing on April 10. 2000. (File Ord. No. 2000-13)
A proposed ordinance zoning property located at 4004 Lunar Drive upon annexation was
introduced, referred to Plan Commission and scheduled for public hearing on April 10. 2000.

Matters not onthe Agenda Councilmember Schneider inquired if the Township was aware of
the annexation of 4004 Lunar Drive. City Manager Sheiffer stated that they were aware of this
annexation. Councilmember Westphal commented that the Administration should explore
putting horse trails in Rockport Park and using a volunteer task force to create the frails. He also
suggested that the City sell the Tallman House and Rotary Gardens. Councilmember Noll
requested the Administration provide assistance to Amtrack in securing a rail service throup~h
Janesville. Councilmember Brien commented that the neiF~hborhood meeting was very good and
suggested that it not be televised. Councilmember Murphy requested a schedule for future
neiF~hborhood meetings and expressed a concern about the quality of the sound system used at
the neiF~hborhood meeting.
Council President Stehura moved to adjourn into closed session pursuant to Wisconsin Statute
Section 19.85(1)(c) for the purpose of considering employment, promotion, compensation or
performance evaluation data of any public employee over which the governmental body has
jurisdiction or exercises responsibility; and 19.85(1)(e) for the purpose of deliberating or
negotiating the purchasing of public properties, the investing of public funds, or conducting
other specified public business, whenever competitive or bargaining reasons require a closed
session; and 19.85(1)(g), conferring with legal counsel for the governmental body who is
rendering oral or written advice concerning strategy to be adopted by body with respect to
litigation in which it is or is likely to become involved. Councilmember Brien seconded the
motion and it passed unanimously.
There being no further business, Council adjourned into closed session at 10:30 p.m.
