2024-2200 RESOLUTION NO. 2024-2200 A resolution authorizing the City Manager to proceed with the sale of property located at 606 W Delavan Drive, 620 W Delavan Drive, 632 W Delavan Dr. WHEREAS, the City of Janesville owns the following described parcels: E.115.5' W.676.64': PT.FRAC.LOT 5 NW1/4: SEC.1-2-12 N. OF W.DELAVAN DR. EX.E.50' JC6107971 E.70' W.462.14' PT.FRAC.LOT 5 NW1/4 SEC.1-2-12 N.OF W.DELAVAN DR. JC610796900001 E.66' W.330.14' THAT PT.FRAC.LOT 5 NW1/4 SEC.1-2-12 N.OF W.DELAVAN DR. JC6107968 WHEREAS, The City of Janesville acquired the properties located at 606 W Delavan Drive and 620 W Delavan Drive in October 2014, through the Rock County Tax Foreclosure Program for the purpose of neighborhood improvement. The City of Janesville acquired the property located at 632 W Delavan Drive through the 2016 Rock County Tax Foreclosure Program for the purpose of neighborhood improvement; and WHEREAS, the three single family homes located on the parcels were in poor condition and demolished immediately after purchase; and WHEREAS, the City of Janesville is selling the vacant parcels AS IS; and WHEREAS, the Plan Commission has reviewed these transactions during their September 2, 2014 and September 6, 2016 meetings and found the purchases and sales to be consistent with established City plans and recommended that the City Council proceed with the sales of this properties, but further noted that the Plan Commission had not reviewed the financial aspects of this transactions; and WHEREAS, these properties are now surplus and no longer needed for any public purpose; and WHEREAS, The City of Janesville has negotiated an agreement to sell the properties to Shawn Ray for$56,000; and WHEREAS, The buyer intends to build new-construction rental properties on each site; and WHEREAS, Wis. Stats. §§ 62.22 (1), 62.23 (17)(a), 62.23 (17)(b), 62.11(5), Chapter 32, and other pertinent Wisconsin Statutes permit the City's acquisition, development, ownership, protection, improvement, conservation, public use, demolition, disposition, sale, conveyance, and other disposal of parkland, open space, riverfront properties, blighted properties, redevelopment, and development properties; and WHEREAS, the Common Council hereby find the sale to be consistent with City plans and in the best interest of and benefit to the City and community. NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL of the City of Janesville that it hereby authorizes and directs the City Manager and the City Clerk to execute on behalf of the City of Janesville, the conveyance of such property; and to negotiate and execute such documents, papers and forms as may from time to time be necessary and/or desirable to effectuate such transaction and the intent of this resolution as the City Manager may decide; and BE IT FURTHER RESOLVED that the City Manager is hereby authorized to take whatever other actions or to make whatever other minor changes that may be necessary to effectuate this land transaction.
