2023-877 FILE ORDINANCE No. 2023-0877 An Ordinance Eliminating the Requirement for a City of Janesville Food License under JGO Section 12-244 and related Ordinances. Whereas, the City of Janesville Code of General Ordinance currently requires a food license for anyone dealing in food service, and is required to renew annually and pay a fee; and Whereas, in the early 1980's, the City of Janesville dispensed with the Board of Health by prior action of the Council. Rock County Health now serves as the primary point of contact ensuring environmental health licensing compliance; and Whereas, a thorough review of licenses and permits required by the City of Janesville finds that this Food License is no longer a relevant requirement and staff is seeking to eliminate this duplication for services now being held to compliance at the County level; and Whereas, staff recommends the following changes to the following ordinance sections that will eliminate the annual City food license, yet maintain the requirement to be approved by the County and maintain operations under County regulations: THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I: ARTICLE IX. FOOD AND DRINK HANDLERS. Section 12-244 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "Sec. 12-244. License; required; sanitation regulations compliance; fees; issuance when. (a) No person shall own, manage or operate within the City any hotel, restaurant, lunchroom, lunch stand or counter, cafeteria, tavern, candy store, fountain or other place dispensing drinks, grocery store, meat market, butcher shop or other place of any kind or nature selling food or drink for human consumption without procuring a proper license(s) therefor. Every person operating any such place of business, as provided in this section, shall keep the same in a clean and sanitary condition and shall comply with all rules, regulations and orders of the proper health authorities of the state, County, and the City. (b) Exempt from the requirement of this article are wrapped food and unwrapped food and candy, soft drink and gumball vending machines and devices." SECTION II: Section 12-245 of the Code of General Ordinances of the City of Janesville is hereby repealed in its entirety. SECTION III: Section 12-615 of the Code of General Ordinances of the City of Janesville is hereby repealed in its entirety. SECTION IV: Section 6-62(d) of the Code of General Ordinances of the City of Janesville is hereby repealed and the remaining subsections renumbered accordingly. SECTION V: Section 6-62(d) of the Code of General Ordinances of the City of Janesville is hereby repealed and the remaining subsections renumbered accordingly. SECTION VI: Section 6-13(b)(2) of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "(b) No other business may be conducted on the licensed premises. This restriction shall not apply to: (1) Food service on Class B premises; (2) Selling wrapped food." SECTION VII: Be it further resolved that this this Ordinance shall take effect upon publication, all food licenses issued July 1, 2023, shall expire on June 30, 2024, and no City of Janesville food licenses will be required in the future.
