2023-2141 RESOLUTION NO. 2023-2141 A resolution to release two 4-foot wide utility easements on property located at 1309 Elida Street. WHEREAS, 4-foot wide utility easements were originally conveyed in 1947 and are shown on the east side of Lot 13 and the north and east sides of Lot 15 of C.J. Rice Addition to Janesville, Wis. as recorded in Volume 14, Page 26 of Plat, Rock County, Wisconsin; and WHEREAS, the owner of said property requests that the City release its rights and interest in the easement areas to allow for the construction of a garage; and WHEREAS, there are no existing public utilities located within said easements; and WHEREAS, the Plan Commission reviewed and found the proposed release and relocation of said utility easements to be consistent with city plans; and WHEREAS, the City Council finds the release of existing easements consistent with the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City of Janesville hereby releases to the following described easement: Located in the NW '/4 of Section 30, T.3N, R.13E of the 4th P.M. of the City of Janesville, Rock County, Wisconsin described as follows: All that part of the 4-foot utility easement located on the east side of Lot 13 (excepting therefrom the north 4 feet of that easement) and the 4-foot utility easements located on the north and east sides of Lot 15 of C.J. Rice Addition to Janesville, Wis. as recorded in Volume 14, Page 26 of Plat, Rock County, Wisconsin. BE IT FURTHER RESOLVED that said easement release by the City of Janesville does not relinquish any inherent rights that other utility companies serving the area may have to use said easement. BE IT FURTHER RESOLVED that upon adoption of this resolution, the City Clerk is directed to record a certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus granting the easement release as herein described.
