2023-2111 RESOLUTION NO. 2023-2111 A resolution ratifying the City Council's closed session approval of settling the litigated assessed values of Walmart and Sam's Club for 2020-2022. WHEREAS, see the two attached and related memoranda of even date from outside legal counsel Ryan Braithwaite, which memoranda are reiterated and incorporated herein by reference as if fully set forth verbatim; and WHEREAS, the Common Council, in closed session on Monday, March 27, 2023, voted unanimously (7-0) to approve the settlement of litigation and assessed values as follows: "Motion made at 6:53 pm CDT by Council Member Marklein, seconded by Council Member Williams, to approve the negotiated assessed values for the Walmart located at 3800 Deerfield Drive on $13,800,000 for 2020-2022 as presented. Motion carried unanimously (7-0). "Motion made at 6:54 pm CDT Council Member Marklein, seconded by Council Member Williams, to approve the negotiated assessed values for the Sam's located at 3900 Deerfield Drive for $9,400,000 for 2020-2022 as presented. Motion carried unanimously (7-0)." and WHEREAS, the Common Council now wish to ratify in open session their closed session settlement and amount authorizations. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Janesville do hereby ratify and approve the above-described assessed value and litigation settlements and amounts for the years 2020-2022 for the above specified properties.
