ORDINANCE NO. 2005-259
An Ordinance amending JGO Section 15.01.120 and creating a time limit for a
Compliance Agreement concerning Raze or Repair Orders, with a penalty and
other relief for violations thereof as set forth in JGO Chapter 15.80.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS
FOLLOWS:
Section I.
Current Sections 15.01.120 B - J of the Code of General Ordinances of the City of
Janesville are hereby renumbered 15.01.120 D - L, respectively.
Section II.
New Sections 15.01.120 B. of the Code of General Ordinance of the City of Janesville is
hereby created to read as follows:
"Section 15.01.120 B. Compliance Agreement Required - Term of 1 Year. If the
Property Owner chooses to repair a building or structure in a situation in which a Raze
or Repair Order has been issued, and if a Compliance Agreement, the terms and
provisions of which are acceptable to the City Building Inspector or his/her designee
and/or other appropriate City Code Official (the "Building Official"), has been entered
into by the Property Owner and approved and entered into by the Building Official in
accordance with JGO 15.80.050, the maximum term for the Compliance Agreement is
one (1) year from the date that the Property Owner is first notified of the violation. This
requirement shall supersede the regular building permit requirement set forth elsewhere
in the City's Ordinances requiring that all work should be completed within two (2)
years. The Compliance Agreement is subject to the "public safety and danger to the
public determination" of the Building Official. The City reserves and retains the right to
either proceed under the original Raze or Repair Order, Condemnation Order, otherwise
condemn the building or structure and/or order it razed and removed, raze and remove,
and/or cause the razing and removal of the Building or Structure in the event that the
Property Owner at any time breaches or fails to comply with any of the provisions of the
Compliance Agreement. The provisions of JGO 15.80.050 are in addition to and not in
lieu of the remedies for condemnation and/or razing/removal of old, unfit, dilapidated,
damaged or deteriorated buildings and structures provided by law."
Section III.
Section 15.01.120 C. of the Code of General Ordinances of the City of Janesville is
hereby created to read as follows:
"C. Also incorporated into this section by reference is JGO Section 15.80.050 as
if fully set forth verbatim herein."
