2022-2027 RESOLUTION NO. 2022-2027 A resolution to release an 8-foot utility easement on property located at 2422 Bond Place. WHEREAS, an 8-foot utility easement was originally conveyed in 1972 and is shown on the west side of Lot 2 of CSM 847966 as recorded in Volume 5, Pages 336-338 of Certified Survey Maps, Rock County, Wisconsin; and WHEREAS, the owner of said property requests that the City release its rights and interest in the easement area to allow for the construction of a shed; and WHEREAS, there are no existing public utilities located within said easements; and WHEREAS, the Plan Commission reviewed and found the proposed release and relocation of said utility easements to be consistent with City plans; and WHEREAS, the City Council finds the release of existing easements consistent with the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City of Janesville hereby releases the following described easement: Located in the NW corner of Section 35, T.3N, R.12E of the 4th P.M. of the City of Janesville, Rock County, Wisconsin described as follows: All that part of an 8-foot utility easement located on the west side of Lot 2 of CSM 847966 as recorded in Volume 5, Pages 336-338 of Certified Survey Maps, Rock County, Wisconsin, excepting the north 10 feet thereof. BE IT FURTHER RESOLVED that said easement release by the City of Janesville does not relinquish any inherent rights that other utility companies serving the area may have to use said easement; and BE IT FURTHER RESOLVED that upon the adoption of this resolution, the City Clerk is directed to record a certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus granting the easement release as herein described.
