2022-1993 RESOLUTION NO. 2022-1993 A resolution to support a grant request to the Wisconsin Department of Natural Resources for funding through the 2022 Land and Water Conservation Fund and Stewardship Local Assistance Programs and the Recreational Trails Program. WHEREAS, the Common Council of the City of Janesville recognizes the benefits of non- motorized transportation infrastructure such as trails to encourage alternative transportation modes, as well as outdoor recreational opportunities for Janesville residents and visitors from across Wisconsin; and WHEREAS, the Wisconsin Department of Natural Resources (DNR) is currently soliciting grant applications for the 2022 Land and Water Conservation Fund and Stewardship Local Assistance Programs and the Federal Recreational Trails Program; and WHEREAS, the City of Janesville intends to submit an application for the construction of the Fisher Creek Trail (from West Court Street to Rockport Road in the City and Town of Janesville) for consideration through the 2022 Land and Water Conservation Fund and Stewardship Local Assistance Programs and the Recreational Trails Program; and WHEREAS, by adopting this Resolution, the Common Council of the City of Janesville declares their intent for the City Administration to submit a grant request to the DNR for funding through the Land and Water conservation Fund and Stewardship Local Assistance Programs and the Recreational Trails Program; and WHEREAS, the City of Janesville's share under the Recreational Trails Program is twenty percent (20%) for eligible design services and construction project costs, and the State share is eighty percent (80%) of eligible design and construction project costs; and WHEREAS, the City of Janesville's share under the Land and Water Conservation Fund and Stewardship Local Assistance Programs is fifty percent (50%) for eligible design services and construction project costs, and the State's share is fifty percent (50%) of eligible design and construction project costs; and WHEREAS, the City of Janesville will maintain records documenting all expenditures made during the grant period and abide by the necessary reporting responsibilities as determined by the Wisconsin DNR; and WHEREAS, the City of Janesville will work cooperatively with employees, agents, and representatives of the Wisconsin DNR during the grant period; and WHEREAS, the City of Janesville intends to comply with all requirements of and will submit all documents and participation requirements to the Wisconsin DNR; and RESOLUTION No. 2022-1993 Page 2 WHEREAS, the Common Council finds that the submission of this grant will be in the best interests of and benefit to the City, its properties, its residents, and taxpayers. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Common Council of the City of Janesville that: 1. All above introductions and recitals are incorporated herein by reference as if fully set forth verbatim; and 2. The City accepts the local share of the project costs and, if awarded the grant, will budget accordingly; and 3. The City Manager is authorized and empowered by the City of Janesville to prepare and submit applications to the Wisconsin Department of Natural Resources for any financial aid that may be available; and 4. The City of Janesville shall take any and all necessary actions to undertake, direct, and complete approved grant activities and comply with State and Federal rules for the program(s); and BE IT FURTHER RESOLVED that the City of Janesville shall comply with state or federal rules for the programs to the general public during reasonable hours consistent with the type of facility; and will obtain from the DNR approval in writing before any change is made in the use of the project site. BE IT FURTHER RESOLVED that the City Manager and his designee(s), on behalf of the City of Janesville, is/are hereby jointly and severally authorized and empowered to negotiate, draft, review, revise, modify, amend, execute, enter into, file and/or record additional applications, agreements, amendments, documents, reports, and letters of understanding concerning this matter, and to take whatever additional other actions that the City Manager may determine in his sole discretion, from time to time and at any time, necessary and/or desirable in the public interest to effectuate the intent of this Resolution and/or the public good. • RESOLUTION No. 2022-1993 Page 3 ADOPTED: April 11, 2022 Motion by: Consent Second by: Consent APPROVED: Councilmember Aye Nay Pass Absent Benson X Jackson X Johnson X Mark A.
