2021-1912 RESOLUTION NO. 2021-1912 A resolution vacating Salisbury Drive. WHEREAS, Salisbury Drive hereinafter designated and previously dedicated for right- of-way purposes is hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street portion; and WHEREAS, owners of the adjoining property to the north desire to combine the right-of- way to their property for the expansion of their business operation; and WHEREAS, it has been determined that the traffic flow will not be impeded by the vacation of such street portion; and WHEREAS, the proposed street vacation has been referred to the Plan Commission for its consideration and report as required by 62.23(5), Wisconsin State Statutes; and WHEREAS, a public hearing was held on vacation of such street portion and notice required by Wisconsin Statutes 66.1003 has been timely published and served; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described street portion be and is hereby vacated and discontinued pursuant to 66.1003 and 62.22(Im), Wisconsin Statutes: Part of the SW 1/4 of the SW 1/4 and Part of the SE 1/4 of the SW 1/4 of Section 35, T.3N. R.12E. of the 4th P.M., City of Janesville, Rock County, Wisconsin. Described as Follows: Commencing at the SW Corner of said Section; thence N1°43'42"W along the West Line of the SW 1/4 of said Section, 1252.50 feet; thence N88°56'27"E 35.0 feet to the NW Corner of a Parcel conveyed to Meadows Development Group, LLC on document no.1346294, also being at place of beginning for the land to be herein described; thence N1°43'42"W 74.70 feet to the North Line of Salisbury Drive; thence N88°56'27"E along said North Line, 885.98 feet; thence S74°21'38"E continuing along said North Line, 52.20 feet; thence N88°56'27"E continuing along said North Line, 770.10 feet to the West Line S. Arch Street; thence S1°53'55"E along said West Line, 70.01 feet to the South Line of Salisbury Drive; thence S88°56'27"W along said South Line, 890.0 feet to a jog in said South Line; thence N1°50'40"W along said jog, 10.31 feet to easterly extension of the North Line of said Parcel (doc.no.1346294); thence S88°56'27"W along said extended line and along said North Line, 816.09 feet to the place of beginning. Intending to describe all that part of Salisbury Drive from the West Line of S. Arch Street to a line parallel to and 35 feet East of the West line of the SW 1/4 of Section 35-3-12. NOW, THEREFORE, BE IT FURTHER RESOLVED that in addition to all other reservations and property rights and privileges retained by the City of Janesville set forth elsewhere in this resolution and/or by other instrument or operation of law, this vacation by the Common Council of the City of Janesville shall take effect upon the completion of the following items/conditions: 1. This vacation shall be contingent upon the recording of a certified survey map to consolidate the vacated right-of-way with the adjoining property owned by the applicant. 2. The certified survey map shall convey municipal utility easements within the vacated right-of-way as determined necessary by the City Engineer. 3. Subject to approval by the City Engineer, the certified survey map shall convey an easement for ingress and egress across the southerly portion of the vacated right-of-way adjacent to its intersection with South Crosby Avenue.
