2021-1900 RESOLUTION NO. 2021-1900
A resolution to release utility easements on Lots 1 and 2 of the plat of Huntington
Place.
WHEREAS, six, 6-foot wide utility easements and two, 8-foot wide utility easements were
dedicated on Lots 1 & 2 of the plat of Huntington Place; as recorded in Volume 32, Page
514 of Plats of Rock County, Wisconsin; and
WHEREAS, the owner of said property requests that the City release the utility easements
to allow for a reconfiguration of residential dwelling units with the Huntington Place Senior
Living Community Planned Unit Development; and
WHEREAS, the owner of said property requests that the City release its rights and interests
in the easement areas; and
WHEREAS, said utility easements have not been used for municipal facilities and are no
longer needed for utility purposes; and
WHEREAS, the Plan Commission reviewed and found the proposed release of said utility
easements to be consistent with city plans; and
WHEREAS, the City Council finds that the release of said utility easements will not be
contrary to the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JANESVILLE that the City of Janesville hereby releases the following described
easements:
Located in the NW corner of Section 16, T.3N, R.12E of the 4th P.M. of the City of
Janesville, Rock County, Wisconsin described as follows:
Four, 6-foot utility easements and two, 8-foot utility easements located on Lot 2,
Huntington Place, City of Janesville Rock County, Wisconsin, except the west 10
feet thereof. Also, the two westernmost 6-foot utility easements located on Lot 1,
Huntington Place, City of Janesville, Rock County, Wisconsin, excepting the south
10 feet thereof.
BE IT FURTHER RESOLVED that said easement releases by the City of Janesville do not
relinquish any inherent rights that other utility companies serving the area may have to use
said easement.
BE IT FURTHER RESOLVED that upon adoption of this resolution, the City Clerk is
directed to record a certified copy of this resolution with the Register of Deeds of Rock
County, Wisconsin, thus granting the easement releases as herein described.
