2005-218 RESOLUTION NO. 2005-218 RESOLUTION AUTHORIZING THE CITY MANAGER TO ACQUIRE PROPERTY AT 212 SOUTH WATER STREET WHEREAS, Sections 62.22 (1), 62.23 (17) (a), 62.23 (17) (b), and Chapter 32 of Wisconsin Statutes permit the acquisition, protection, and conservation of parkland, open space, and riverfront properties; and WHEREAS, the City Council has adopted a Riverfront Development Strategy that calls for the acquisition, protection, and conservation of lands along the Rock River for parks, recreation and public purposes, including the riverfront property located at 212 South Water Street in the City of Janesville, County of Rock, State of Wisconsin; and WHEREAS, the City of Janesville has negotiated an offer to purchase the Dooley property at 212 South Water Street in the amount of $142,500, and the property owner is eligible for an estimated $45,000 for relocation benefits and moving expenses; and WHEREAS, the City Council authorizes that this project be funded through the 2006 General Fund Promissory Note; and WHEREAS, the Janesville Plan Commission has reviewed this proposed acquisition on October 17, 2005 and found it to be consistent with long range City plans, but not commenting upon the financial aspects ofthe transaction; and WHEREAS, the Common Council of the City of Janesville finds that the purchase of the Dooley Photography property at 212 South Water Street is in the best interest of the and benefit to the City, its citizens, and the overall community; and NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville that they hereby approve and authorize the City Manager and/or his designee(s) to purchase such property from Dennis and Angela Dooley on behalf of the City as the City Manager may deem necessary or desirable to effectuate the intent of this resolution; and BE IT FURTHER RESOLVED, that the City Manager and/or his designee(s) on behalf of the City of Janesville, is/are hereby authorized and empowered to negotiate, draft, modify, review, execute, and enter into additional agreements, record, file and/or make minor modifications and/or amendments to any and all documents, papers, forms, and agreements, and to make whatever other actions as the City Manager may determine, from time to time and at any time, necessary and/or desirable to effectuate the intent of this resolution.
