Minutes 10-10-05.doc PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING Approved: October 24, 2005 October 10, 2005 VOL. 56 NO. 14 Regular meeting of the City Council of the City of Janesville held in the Municipal Building on October 10, 2005. The meeting was called to order by Council President Tom Wellnitz at 7:00 p.m. Councilmember Williams led the Council in the Pledge of Allegiance. Present: Council President Tom Wellnitz. Councilmembers Brunner, Brien, Williams, Tim Wellnitz, and Addie. Absent: Councilmember DeGarmo. CONSENT AGENDA Minutes of the regular meeting of September 26, 2005. Minutes of the closed session of September 26, 2005. Licenses; and Recommendations of the Alcohol License Advisory Committee. Waiver of procedure for special assessments for storm sewer, sidewalk and street light charges for Rockport Ridge Estates Seventh Addition, Martin. Waiver of procedure for special assessments for storm sewer, sidewalk and street light charges for Pine Ridge Estates Fourth Addition – Webco, Inc. Council President Tom Wellnitz asked the audience if anyone would like to comment on the outdoor seating request from Spirits, Inc. No one responded. He then stated that the Consent Agenda would be approved if there were no objections from the Council. There were none. OLD BUSINESS 1. Requests and comments from the public regarding items on the Agenda not requiring a public hearing. There were none. 2. A proposed ordinance rezoning a portion of the property located at 1700 South River Road from R3M to R3 received its second reading and public hearing. The public hearing was opened. Marion Wozniak, representing Cedar Crest, explained Cedar Crest’s facilities and the different levels of care. Joe Stadelman, Angus Young architect, explained the proposed plan to develop the site. Steve Ihus, 1807 South River Road; Mike Roberts, 1739 South River Road; and Mary Conway, 1731 South River Road, spoke in opposition to the ordinance. Gerry Ginner, 1715 South River Road, spoke in support of the ordinance if the site was properly landscaped. Nancy Stabb, 1200 South River Road, and Chris Hadley, 1635 South River Road, expressed their concern about losing mature trees when the site is developed. The public hearing was closed. Councilmember Brunner moved to adopt said ordinance with the condition that the green space on the property be a part of the development process, seconded by Councilmember Addie and passed unanimously. (File Ord. No. 2005-291) 3. Further review of the proposed public alley at the Youth Sports Complex. Councilmember Williams moved to approve Option 2, which will construct the public alley with limited curb and gutter, seconded by Councilmember Tim Wellnitz and passed unanimously. 4. City Manager’s report. A) Enchanted Forest. Shelly Hansel, Recreational Programmer, explained that the Enchanted Forest depicts scenes from childhood fairy tales and is performed by the Craig and Parker High School drama clubs. The Enchanted Forest is scheduled from October 26 through October 29 at Palmer Park. NEW BUSINESS 1. Presentation of the proposed FY2006 City and Library Budgets. City Manager Steve Sheiffer gave a PowerPoint slide presentation highlighting the proposed budgets. The City Council will begin reviewing the budgets at their first study session on Thursday, October 13, 2005. 2. Action on a proposed resolution authorizing the City Manager to apply for a Brownfield Grant for the Riverside Plating site, 1623 Beloit Avenue, Janesville, Wisconsin. Councilmember Brien moved to adopt said resolution, seconded by Councilmember Williams and passed unanimously. (File Res. No. 2005-210) 3. Youth in Government Program Proposal. In cooperation with the Janesville School District, the Administration developed a Youth in Government program which would allow students to: 1. Interact with Councilmembers during three meetings, (or) 2. Take a two-hour tour of a city facility and meet with a panel of staff to ask questions. Councilmember Tim Wellnitz moved to approve both programs, seconded by Councilmember Brien and passed unanimously. 4. Requests and comments from the public on matters which can be affected by Council action. Kris Beeler, 2351 Summit Drive, opposes the Hendricks Development project because of the adverse effects on her subdivision. Mick Gilbertson, 417 West Milwaukee Street, requests the City address the negative environment around the Armory. 5. Matters not on the Agenda. Councilmember Brien requested an update on the proposed ordinance creating a distance requirement between daycares and alcohol establishments. Councilmembers Addie and Brien will sponsor this ordinance. Councilmember Williams suggested that the City request exempt property taxpayers to pay a payment in lieu of taxes. 6. Councilmember Tim Wellnitz moved to convene into closed session, pursuant to Wisconsin Statute Section 19.85 (1) (e), for the purpose of deliberating or negotiating the purchase of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session, specifically the potential acquisition of a downtown public use or redevelopment site, seconded by Councilmember Williams and passed unanimously.
