2005-282 ORDINANCE NO. ~005-~a~ An ordinance annexing territory in Section 3, T.2N., R.12E. ofthe 4th P.M., Town of Rock, Rock County, Wisconsin. WHEREAS, a petition signed by all the owners of all the land within such territory proposed to be annexed has been filed with the City Clerk; and WHEREAS, there are no electors residing in the territory; and WHEREAS, the necessary notices have been duly prepared, provided and served as required by law to all persons affected; and WHEREAS, this ordinance does not contain temporary zoning; and WHEREAS, the Department of Administration has not found the proposed annexation to be against the public interest; and WHEREAS, the Common Council has determined that this annexation is in the public interest. NOW THEREFORE THE COMMON COUNCil OF THE CITY OF JANESVlllE DO ORDAIN AS FOllOWS: SECTION I. The territory described as follows is hereby annexed to the City of Janesville. Part of the East Y:1 of the SW ~ and part of Government Lots 2 and 3 in the southeast ~ of Section 3, T.2N., R.12E. of the 4th P.M., Town of Rock, Rock County, Wisconsin. Described as follows: Commencing at an aluminum monument at the west ~ corner of Section 3; thence S75°44'42"E 2385.05 feet to a pk nail at the most easterly corner of Lot 1 of a certified survey map recorded in Volume 1, Page 180, also being at the place of beginning for the land to be herein described; thence S46°49'29"E along the southwesterly line of Rockport Park Drive, 470.90 feet to an iron pin; thence S57°52'32"E continuing along said southwest line, 505.60 feet to an iron pin on the northwest line of C.T.H. "0"; thence S35°52'29"W along said northwest line 205.58 feet to an iron pin; thence S31°03'41'W continuing along said northwest line, 3.93 feet to an iron pin; thence N67°42'56"W along a fence line (portions of this fence have been previously surveyed by R.H. Batterman & Co. Inc. - Order No. 25618) 279.01 feet to an iron pin; thence N67°42'16"W continuing along said fence line, 294.66 feet to an iron pin; thence N63°49'15"W continuing along said fence line, 98.62 feet to an iron pin; thence N68°33'1 O"W continuing along said fence line, 98.87 feet to an iron pin; thence N72°09'08'W continuing along said fence line, 483.45 feet to a nail set in a wooden fence post; thence NOo03'38"E 138.47 feet to an iron pin on the south line of Lot 1 of a certified survey map as recorded in Volume 25, Pages 222-224; thence S54°18'13"E along said south line 3.37 feet to an iron pin at the most westerly corner of said Lot 1, Volume 1 Page 180; thence S54°23'54"E 215.08 feet to an iron pin at the most southerly corner of said Lot 1; thence N48°33'36"E 459.76 feet to the place of beginning. SECTION II. After this annexation becomes effective, the above described property shall be exempt from and not subject to further taxation and assessments in the Town of Rock and thence forth shall be subject to taxation and assessment as part of the City of Janesville for any and all purpose provided by law. ORDINANCE NO. 2005-282 PAGE 2 SECTION III. All the territory annexed by this ordinance is hereby made part of Ward 27 of the City of Janesville. SECTION IV. There are no residents in the area proposed for annexation. SECTION V. The annexation area is within the Janesville School District. SECTION VI. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
