2005-278 ORDINANCE NO. 2005 - 278 An ordinance increasing the storm sewer subdivision assessment rate to $6,410 and creating a new $8,925 rate for the northeast drainage basin. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 17.44.010 B. of the Code of General Ordinances of the City of Janesville is hereby renumbered and amended to read as follows: "B. (1) At the time any plat, certified surveyor other subdivision is presented for approval, or at the time a building permit is requested for any parcel that has not paid storm sewer assessment, other than for those areas specifically defined or designated elsewhere in this ordinance, the developer shall deposit with the City Clerk a sum of money to be used to pay for the design and construction of storm sewers and storm drainage improvements. Except as set forth elsewhere in this ordinance, the City shall charge and developers shall pay to the City Six Thousand Four Hundred Ten and 00/100 Dollars ($6,410.00) per acre for the design and construction of storm sewers and storm drainage improvements. No such money shall be spent for any purpose except to pay for the design and construction of storm sewers and storm drainage improvements. The total cost shall be computed by multiplying the cost per acre by the total number of acres included in the plat, certified surveyor other subdivision. The assessment rate will be evaluated annually and a new rate established each year to assure recovery of not less than 100% of the cost of storm sewer design and construction. The City Council shall be advised of the new rate and the Common Council hereby authorizes the adjustment and assessment of such rates. (2) (a) The Northeast Drainage Basin is a specifically defined area NE of and including part of the City of Janesville that due to unique topographic, drainage and related characteristics and factors requires a large 60 acre drainage pond and related extensive and expensive storm water drainage and sewer work specific to that area and not typical for other areas in and immediately surrounding the City at this time. The Northeast Drainage Basin is defined in sub. B. (2) (b). At the time any plat, certified surveyor other subdivision is presented for approval, or at the time a building permit is requested for any parcel in the Northeast Drainage Basin, the developer shall deposit with the City Clerk a sum of money to be used to pay for the design and construction of storm sewers and storm drainage improvements in the Northeast Drainage Basin. For this specifically defined area, the City shall charge and developers shall pay to the City Eight Thousand Nine Hundred Twenty Five and 00/1 00 Dollars ($8,925.00) per acre to be used to pay for the design and construction of storm sewers and storm drainage improvements therein. No such money shall be spent for any purpose except to pay for the design and construction of storm sewers and storm drainage improvements. (2) (b) The "Northeast Drainage Basin" is defined as and shall include the following areas set forth in the attached map labeled Exhibit A, which map is incorporated herein as if fully set forth verbatim. C. Such deposit shall be made before the involved plat, certified surveyor other subdivision will be approved by the City. D. As a method of paying the deposit, a waiver of assessment procedure in lieu of the deposit shall satisfy the requirement under this section upon approval by the Council. E. No charge shall be made for any plat, certified surveyor other subdivision which receives no benefit whatsoever from storm sewers paid for by such deposits. F. The Plan Commission shall be the agency which shall review any initial determination made pursuant to this section. G.
