2020-784 FILE ORDINANCE NO. 2020-784
An ordinance amending the Vacant Building Registration Program, with penalties and other relief for
violations thereof as set forth in JGO 22-235.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS:
SECTION I. Chapter 22, Article VIII, Sec 22-228 ("Definitions") of the Code of General Ordinances of the
City of Janesville ("Vacant Building Registration Program") is hereby amended to read as follows:
"L. Occupied. When a business is open to the public, when a business or manufacturing activity is performed
therein, or when one or more persons legally reside therein as their primary residence. or when any personal
property is moved therein Any building or structure shall be deemed occupied if one or more persons actually
conducts a lawful business or resides residents in all or any part of the building as the licensed business-
occupant, or as the legal or equitable owner/occupant(s) or tenant(s) on a permanent, non-transient basis, or
any combination of the same. For purposes of this chapter, evidence offered to prove that a building is so
occupied may include, but shall not be limited to, the regular receipt of delivery of regular mail through the U.S.
Postal Service; proof of continual telephone, electric gas, heating, water, and sewer usage."
SECTION II. Chapter 22, Article VIII, Sec 22-231. ("Exceptions") of the Code of General Ordinances of the
City of Janesville is hereby amended to read as follows:
"A. A property that meets the conditions under section 8.62.050 shall be registered under the Vacant Building
Registration Program unless the following conditions are met:
2. A property that is either actively being offered for sale or lease or is actively being offered for rent
shall be exempt from registration for no longer than (six) 6 months from when such listing or advertising
commenced. After such time, the property will no longer be exempt and must then immediately comply with
the registration and other requirements set forth in this chapter."
