2020-788 File Ordinance No. 2020-812 An ordinance repealing Janesville's Class A alcohol beverage license quotas for fermented malt beverages and intoxicating liquors, with penalties for violation thereof as set forth in JGO 6-104. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: Section I. Janesville General Ordinance subsections 6-57 (a) and (b) are hereby amended to read as follows: "Sec. 6-57. -Class A licenses. (a) The City may issue Class A fermented malt beverage alcohol licenses for the sale of fermented malt beverages for premises within the municipality. Such a Class A license authorizes retail sales of fermented malt beverages for consumption off the premises where sold and in original packages and containers. (b) Unless otherwise provided by state law, there shall be no quota as to the maximum number of Class A fermented malt beverage alcohol licenses issued or held in the City limits." Section II. Janesville General Ordinance subsections 6-57 (c) and (d) are hereby repealed. Section III. Janesville General Ordinance subsection 6-57 (e) is hereby renumbered 6-57 (c). Section IV. Janesville General Ordinance subsections 6-97 (a) and (b) are hereby amended to read as follows: "Sec. 6-97. - Class A licenses. (a) The City may issue Class A intoxicating liquor alcohol beverage licenses for the sale of intoxicating liquor for premises within the municipality. Such a Class A license authorizes retail sales of intoxicating liquor for consumption off the premises where sold and in original packages and containers. (b) Unless otherwise provided by state law, there shall be no quota as to the maximum number of Class B fermented malt beverage alcohol licenses issued or held in the City limits." Section V. Janesville General Ordinance subsections 6-97 (c) and (d) are hereby repealed. Section VI. Janesville General Ordinance subsection 6-97 (e) is hereby renumbered 6-97 (c). THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 38-257 (a). of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "Sec. 38-257. - Sleeping in vehicles unlawful. (a) It is unlawful for any person to sleep in a parked vehicle while on any public street, public parking lot or park, from the hours of 10:00 p.m. to 6:00 a.m., unless otherwise posted. The extension of the authorization of allowing sleeping in parked vehicles between the hours of 10:00 p.m. and 6:00 a.m. is approved; and such extension shall only apply and be extended to the Municipal Lot located at 105 North Jackson Street, Janesville, WI, USA; and that such extension of this parking privilege shall expire and be revoked on March 31, 2020, or sooner if so ordered. The City Manager shall immediately commence discussions with Rock County Government and/or such other agencies of the City Manager's choosing, for purposes of transferring overnight parking responsibilities to such agencies who have either the legal or mission-authorizing corporate provisions to provide such parking privileges and necessary support services, including, but not limited to, case management and other such related services that they would deem necessary. If in the event these negotiations between the City Manager and said agencies and/or organizations fails to result in the consummation of their acceptance of responsibility, such parking privilege provided for herein shall cease in any event on September 30, 2020, or before such a date if so authorized by the City Council or by Order of the Chief of Police of the City of Janesville. (b) It is unlawful to sleep in a parked vehicle on private property, at any time, without the consent of the owner or lessee."
