2020-1732 RESOLUTION NO. 2020-1732 A resolution vacating a portion of Myrtle Way. WHEREAS, a portion of Myrtle Way hereinafter designated and previously dedicated for right- of-way purposes is hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street portion; and WHEREAS, the petitioners desire to vacate a portion of Myrtle Way to facilitate a realignment of the existing right-of-way and allow for a more appropriate street cross-section; and WHEREAS, dedication of new right-of-way to accommodate the realignment and replacement of Myrtle Way proposed for vacation is being provided by owners of the adjoining property in conjunction with this request; and WHEREAS, the street vacation shall take effect upon the recording of a Certified Survey Map that dedicates right-of-way necessary for the replacement of that portion of Myrtle Way being vacated; and WHEREAS, it has been determined that the traffic flow will not be impeded by the vacation of such street portion; and WHEREAS, the proposed street vacation has been referred to the Plan Commission for its consideration and report as required by 62.23(5), Wisconsin State Statutes; and WHEREAS, a public hearing was held on vacation of such street portion and notice required by Wisconsin Statutes 66.1003 has been timely published and served; and NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described street portion be and is hereby vacated and discontinued pursuant to 66.1003 and 62.22(Im), Wisconsin Statutes: THAT PART OF MYRTLE WAY DEDICATED TO THE PUBLIC ON A CERTIFIED SURVEY MAP, AS RECORDED IN VOLUME 39, PAGES 416 THRU 419 OF CERTIFIED SURVEY MAPS OF ROCK COUNTY, AS DOCUMENT NO. 2131315, LOCATED IN PART OF THE NW. '/4 OF THE NW. ' AND PART OF THE NE. % OF THE NW. '/4 OF SECTION 5, T.2N., R.13E., OF THE 4TH P.M., CITY OF JANESVILLE, ROCK COUNTY, WISCONSIN. DESCRIBED AS FOLLOWS: Commencing at an aluminum monument at the NW Corner of said Section 5; thence SO°12'45"W along the West Line of the NW 1/4 of said Section, 1411.22 feet to the North Line of a Certified Survey Map recorded in Volume 10, Page 120; thence S89°21'42"E along said North Line, 69.13 feet to the place of beginning for the land to be herein described; thence Northeasterly along a curve to the right 154.24 feet, having a radius of 235.0 feet and a chord bearing N64°07'26"E 151.49 feet; thence N82°55'38"E 30.41 feet; thence Northeasterly along a curve to the left, 160.13 feet, having a radius of 215.0 feet and a chord bearing N61°35'24"E 156.46 feet; thence N40°15'10"E 236.04 feet; thence Northerly along a curve to the left 185.14 feet, having a radius of 215.0 feet and a chord bearing N15°34'59"E 179.48 feet; thence N80°54'48"E 70.00 feet; thence Southwesterly along a curve to the right 245.42 feet, having a radius of 285.0 feet and a chord bearing S15°34'59"W 237.91 feet; thence S40°15'10"W 236.04 feet; thence Southwesterly along a curve to the right, 212.27 feet, having a radius of 285.0 feet and a chord bearing S61°35'24"W 207.40 feet; thence S82°55'38"W 17.46 feet to said North Line of Certified Survey Map (Vol. 10, Page 120); thence N89°21'42"W along said North Line, 157.78 feet to the place of beginning. NOW THEREFORE BE IT FURTHER RESOLVED that the City of Janesville hereby retains a blanket easement for utility purposes over the entire land area herein described.
