2019-1713 RESOLUTION NO. 2019-1713 A resolution authorizing the City of Janesville's submission of grant requests to the Wisconsin Department of Transportation (WisDOT) for funding through their Multimodal Local Supplement Program. WHEREAS, the Common Council of the City of Janesville recognize the benefits of non-motorized transportation infrastructure such as trails to encourage alternative transportation modes and provide recreational opportunities; and WHEREAS, the Common Council of the City of Janesville recognizes the importance of maintaining the City's infrastructure, including the reliability of its fleet of vehicles which serve the public; and WHEREAS, the Glacial River bike trail section construction is a strategic next link to our bike trail system which has no secured funding source and is an eligible project for this grant program; and WHEREAS, two transit fleet vehicles meet the federal replacement criteria; and WHEREAS, replacement of two transit vehicles and the renovation of the downtown Transfer Center have no secured funding source and are eligible projects for this grant program; and WHEREAS, all three proposed projects are supported by the Janesville Area 2015-2050 Long Range Transportation Plan, adopted May 19, 2016 by the Janesville Area Metropolitan Planning Organization Policy Board; and WHEREAS, both proposed projects for public transportation improvements are supported by the Transit Development Plan for the Janesville Transit System; and WHEREAS, by adopting this resolution, the Common Council declare their intent for the City Administration to submit three grant requests to WisDOT for funding through their Multimodal Local Supplement Program to fund the construction of an off-road trail segment and public transportation improvements within the City; and WHEREAS, the City of Janesville share under this grant program is ten percent (10%) of eligible project costs, and the Wisconsin Department of Transportation's share is ninety percent (90%) of eligible projects costs; and WHEREAS, the City of Janesville will maintain records documenting all expenditures made during the grant period and abide by the necessary reporting responsibilities as determined by the WisDOT; and WHEREAS, the City of Janesville will work cooperatively with employees, agents, and representatives of the WisDOT during the grant period; and WHEREAS, the City of Janesville intends to comply with all requirements of and will submit all documents and participation requirements, to the WisDOT; and WHEREAS, the Common Council find that the submission for and use of each of these grants will be in the best interests of and benefit to the City, its properties, its residents, and taxpayers. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Common Council of the City of Janesville that: 1. All above introductions and recitals are reiterated and incorporated herein by reference as if fully set forth verbatim; and 2. The City Administration is authorized on behalf of the City of Janesville to prepare and submit applications for, and request funds and assistance available from, the Wisconsin Department of Transportation for these three grants; and 3. The City of Janesville shall take any and all necessary actions to undertake, direct, and complete approved grant activities, and comply with State and Federal rules for the program(s); and BE IT FURTHER RESOLVED, by the Common Council of the City of Janesville that they hereby approve and authorize the City Administration to take actions necessary to provide the local share "matching" funding for these projects if awarded, currently estimated in the amount of $97,891 and 20/100 Dollars ($97,891.20) for the Glacial River Trail; One Hundred Thousand and 00/100 Dollars ($100,000; or $50,000 per bus) for replacement transit fleet vehicles; and Seventy Five Thousand and 00/100 Dollars ($75,000) for the renovation of the JTS Transfer Center to come from future City borrowing proceeds; and that no funds from sources other than future borrowing on promissory notes or bonds are expected to be used, reserved, allocated on a long- term basis, or otherwise set aside by the City for the project, except as permitted by the Internal Revenue Code of 1986, as amended. This declaration of official intent is consistent with the budgetary and financial circumstances of the City. The purpose of this Resolution is to satisfy the "official intent requirement" of Treasury Regulation Section 1.150-2; and BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf of the City of Janesville, is/are hereby jointly and severally authorized and empowered to negotiate, draft, review, revise, modify, amend, execute, enter into, file and/or record additional applications, agreements, amendments, documents, reports, and letters of understanding concerning this matter, and to take whatever additional other actions that the City Manager may determine in his sole discretion, from time to time and at any time, necessary and/or desirable in the public interest to effectuate the intent of this Resolution and/or the public good.
