2005-161 RESOLUTION NO. 2005-161 A Resolution Authorizing the Dedication of City of Janesville Owned Land for the Widening and Reconstruction of Delavan Drive. WHEREAS, the City of Janesville, a Wisconsin Municipal Corporation located in the County of Rock, State of Wisconsin, is the owner of certain real property located on Delavan Drive, legally described as set forth in the attachment hereto which is incorporated herein as if fully set forth verbatim. WHEREAS, the Common Council of the City of Janesville recognize the need to widen Delavan Drive from Industrial Court to Beloit Avenue as part of the selected route for the Delavan Drive Improvement Project; and WHEREAS, the Common Council previously approved this transportation project when they adopted Resolution No. 2004-78 on the 13th day of September, 2004; and WHEREAS, the Common Council hereby find that widening of Delavan Drive is a public highway project and requires additional right-of-way; and WHEREAS, the City of Janesville is the owner of the above described abutting real property and may designate and dedicate the additional right-of-way as necessary for such public highway purposes pursuant to Sections 62.11 (5), 62.22, 66.0101 and other pertinent provisions of the Wisconsin Statutes and Constitution; and WHEREAS, the properties required for this transportation project were reviewed by the Janesville Plan Commission on September 7, 2004 and were found to be consistent with City Plans. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Janesville that the above described 0.0165 acres of land is hereby designated and dedicated by the City of Janesville for permanent highway right-of-way, as described above, for widening and reconstruction of Delavan Drive; and BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf of the City of Janesville, is/are hereby authorized and empowered to negotiate, draft, modify, review, execute, and enter into additional agreements, payments, and record, file, and/or make minor modifications and/or amendments to any and all documents, papers, forms, and agreements, and to take whatever other actions as the City Manager may determine from time to time and at any time, necessary and/or desirable to effectuate the intent of this Resolution.
