RESOLUTION NO. 2005-159
A resolution authorizing the release of an easement located on property at 942 Cambridge
Drive.
WHEREAS, a thirty (30) foot wide temporary water facilities easement was dedicated along the
northerly line of Lot 227 of Hamilton Heights Fifth Addition Subdivision recorded on August 23,
2001, Volume 32 of Plats, Pages 526 and 527, Document No. 1508425 in the office of the
Register of Deeds for Rock County, Wisconsin.
WHEREAS, the easement has not been used for municipal facilities and can be relocated to an
alternative lot within the Hamilton Heights Fifth Addition Subdivision; and
WHEREAS, the City Engineering and Planning Departments have determined that said relocation
of the easement is acceptable, thus allowing for installation of temporary water facilities necessary
to provide adequate water pressure within the surrounding area; and
WHEREAS, the property owner has agreed to grant a new easement for said purposes rendering
the previously dedicated easement no longer necessary for public use; and
WHEREAS, the City Council finds the acceptance of a new easement and the subsequent release
of said existing temporary water facilities easement are not contrary to the public interest.
NOW, THEREFORE, BE IT RESOLVED that the following described temporary water facilities
easement is hereby released:
Located in the NE 1/4 of the SW1/4 of Section 27, T.3N., R.12E. of the 4th P.M.,
City of Janesville, Rock County, Wisconsin described as follows:
The north 30-feet of Lot 227 of Hamilton Heights Fifth Addition Subdivision recorded on August
23, 2001, Volume 32 of Plats, Pages 526 and 527, Document No. 1508425 in the office of the
Register of Deeds for Rock County, Wisconsin.
BE IT FURTHER RESOLVED THAT upon adoption of this resolution and receipt of a signed
easement dedicating a new temporary water facilities easement acceptable to the City Engineer,
the City Clerk is directed to record a certified copy of this resolution with the Register of Deeds of
Rock County, Wisconsin, thus granting the release of the easement described above.
