Minutes 03-14-05.doc PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING Approved: March 28, 2005 March 14, 2005 VOL. 55 NO. 30 Regular meeting of the City Council of the City of Janesville held in the Municipal Building on March 14, 2005. The meeting was called to order by Council President Steeber at 7:00 p.m. Bill Truman led the Council in the Pledge of Allegiance. Present: Council President Steeber, Councilmembers Tim Wellnitz, Williams, Brien, Tom Wellnitz, DeGarmo and Addie. CONSENT AGENDA Minutes of the regular meeting of February 28, 2005. Minutes of the closed session of February 28, 2005. Licenses; and Recommendations of the Alcohol License Advisory Committee (ALAC). Council President Steeber stated the Consent Agenda would be approved if there were no objections. There were none. OLD BUSINESS 1. Requests and comments from the public regarding items on the Agenda not requiring a public hearing. Andreah Briarmoon, 339 South Locust Street, asked the Council to postpone their vote on a proposed resolution authorizing the issuance of General Obligation Promissory Notes. 2. & 3. Councilmember Tom Wellnitz left the Council table. Proposed ordinances annexing property located south of East Rotamer Road east and adjoining the Rotamer Ridge Estates Subdivision (2005-262) and zoning said property to R1 upon annexation (2005-263) were given their second reading and public hearing. No one spoke at the public hearing. Councilmember Williams moved to adopt said ordinances, seconded by Councilmember Addie and passed unanimously. (File Ord. Nos. 2005-262 and 2005-263) 4. Councilmember Tom Wellnitz returned to the Council table. A proposed ordinance creating an all-way stop at Dodge Street and South Franklin Street received its second reading and public hearing. The public hearing was opened. Michael Gilbertson, 3400 N. Edgewood Drive, spoke in support of the ordinance. The public hearing was closed. Councilmember Tom Wellnitz moved to adopt said ordinance, seconded by Councilmember DeGarmo and passed unanimously. (File Ord. No. 2005-264) 5. Proposed ordinances implementing traffic control changes at the intersection of North Crosby Avenue, Highland Avenue and North Marion Avenue received their second reading and public hearing. The public hearing was opened. Robert Knapp, 651 North Crosby Avenue, and Douglas Hearn, 715 North Marion Avenue, both spoke in support of the ordinance. The public hearing was closed. Councilmember Addie moved to deny said ordinances, seconded by Councilmember Tim Wellnitz and passed by the following vote: Aye: Councilmembers Tim Wellnitz, Williams, DeGarmo, and Addie. Nay: Councilmembers Brien, Steeber and Tom Wellnitz. (File Ord. Nos. 2005-265 and 2005-266) 6. City Manager’s Report. A) Bike Trail System and Recent Expansions. Tom Presney, from the Parks Department, gave a presentation on the city’s bike trail system. He showed the features and attributes of the existing system and proposed future trail expansions. NEW BUSINESS 1. A proposed resolution vacating a portion of Hoya Lane and Old Kennedy Road north of Terapin Trail received its public hearing. No one spoke at the public hearing. Councilmember Williams moved to adopt said resolution, seconded by Councilmember Brien and passed unanimously. (File Rev. Res. No. 2005-135) 2. Action on a proposed resolution authorizing the issuance of $4,500,000 General Obligation Promissory Notes, Series 2005, and providing the details thereof. Councilmember DeGarmo moved to adopt said resolution, seconded by Councilmember Tom Wellnitz and passed unanimously. (File Res. No. 2005-157) 3. Councilmember Tom Wellnitz left the Council table. Action on a proposed Preliminary Resolution for Public Works Projects Bid Schedule “C” – 2005 and schedule a public hearing for the Final Resolution. Councilmember Williams moved to adopt said resolution, seconded by Councilmember Addie and passed unanimously. Council President Steeber scheduled the public hearing for the Final Resolution on April 25, 2005. (File Res. No. 2005-156) 4. Councilmember Tom Wellnitz returned to the Council table. A proposed ordinance regulating pre-existing non-conforming outdoor wood burning furnaces within the City of Janesville was introduced and scheduled for public hearing on April 11, 2005. (File Ord. No. 2005-267) 5. A proposed ordinance amending the zoning ordinance to allow kennels as a conditional use in the M1 and M2 zone districts was introduced, referred to Plan Commission and scheduled for public hearing on April 11, 2005. (File Ord. No. 2005-268) 6. A proposed ordinance annexing property within the 4200 block of John Paul Road was introduced and scheduled for public hearing on April 11, 2005. (File Ord. No. 2005-269) 7. A proposed ordinance zoning property located within the 4200 block of John Paul Road to R3M upon annexation was introduced, referred to Plan Commission and scheduled for public hearing on April 11, 2005. (File Ord. No. 2005-270) 8. Requests and comments from the public on matters which can be affected by Council action. Andreah Briarmoon, 339 South Locust Street, expressed her concern about Code Enforcement procedures. Ty Bollerud, 424 South Pearl Street, requested that all committee appointments be approved by the Council. 9. Matters not on the Agenda. Councilmember Williams requested letters be sent to outdoor wood burning stove owners and other interested parties regarding the public hearing on April 11, 2005. He also stated that all committee appointments are approved by the Council. 10.
