2019-1701 FILE RESOLUTION NO. 2019-1701 RESOLUTION RESCINDING APPROVAL OF FILE RESOLUTION NO. 2019-1686 CREATING TAX INCREMENTAL DISTRICT NO. 38, APPROVING ITS PROJECT PLAN, AND ESTABLISHING ITS BOUNDARIES CITY OF JANESVILLE, WISCONSIN WHEREAS, the Common Council of the City of Janesville approved File Resolution No. 2019- 1686 on August 26, 2019, creating the City of Janesville Tax Incremental District No. 38 and its initial project plan in accordance with the provisions of Wisconsin Statutes Section 66.1105; and WHEREAS, the Joint Review Board has not conducted the Final Joint Review Board Meeting to approve the project plan and the creation of Tax Incremental District No. 38; and WHEREAS, the intent of the creation of the new Tax Incremental District No. 38 principally is to provide financial assistance to the development of a new, 115-unit multiple family residential project and to promote other redevelopment within the Milton Avenue Corridor; and WHEREAS, Tax Incremental District No. 38 was established prior to October 1 which sets the effective date of the District as January 1, 2019; and WHEREAS, the timing of the development project and the developer requested financial assistance necessitates the City of Janesville and its Common Council to modify the effective date of the District to January 1, 2020; and WHEREAS, rescinding the approval of Tax Incremental District No. 38 and its initial project plan will allow the Administration to establish the District with the effective date of January 1, 2020; and WHEREAS, this District will be recreated and the proposed initial project plan reapproved by the Common Council in the near future within the dates provided by state law for the above effective date to occur; and WHEREAS, the potential developer for the rental unit construction project and District requests this rescission and recreation process and the City Administration concurs in this recommendation and request; and WHEREAS, the Wisconsin Department of Revenue, State and Local Finance Division, in an email on Tuesday, September 10, 2019 11:01 a.m. determined and approved, in pertinent part, that: "Since the TID creation year is the only change the City is making and the public hearing was held recently, the council could rescind the resolution, adopt a new creation resolution with creation date 1/1/20 in October 2019 and have a final JRB meeting. "We would allow this timeframe for creating a 2020 TID and there would be no need to start the process over." [The entire email and email string are attached hereto and incorporated herein by reference as if fully set forth verbatim]; and 1 Rescinding Approval of File Resolution No. 2019-1686 Resolution No. 2019-1701 Page 2 WHEREAS, Janesville General Ordinance 2.04.130 permits the Common Council to rescind a previously adopted resolution in accord with the provisions set forth therein. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville that they hereby rescind adopted File Resolution No. 2019-1686 and approval of the initial project plan because a new resolution creating the City of Janesville Tax Incremental District No. 38 in accordance with the provisions of Wisconsin Statutes Section 66.1105 is anticipated to be reviewed by the Common Council in a forthcoming meeting; and BE IT FURTHER RESOLVED, that the City Manager and/or his designee(s), on behalf of the City of Janesville, is/are hereby authorized to administratively take whatever actions he or they deem necessary and/or desirable to effectuate the intent and purposes of this Resolution.
