Minutes 01-24-05.doc PROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING Approved: February 14, 2005 January 24, 2005 VOL. 55 NO. 26 Regular meeting of the City Council of the City of Janesville held in the Municipal Building on January 24, 2005. The meeting was called to order by Council Vice President Tom Wellnitz at 7:00 p.m. Boy Scout Troop 450 led the Council in the Pledge of Allegiance. Present: Council Vice President Tom Wellnitz, Councilmembers Tim Wellnitz, Williams, Brien, DeGarmo and Addie. Absent: Council President Steeber. CONSENT AGENDA Minutes of the regular meeting of January 10, 2005. Licenses; and Recommendations of the Alcohol License Advisory Committee (ALAC). Action on a financial gain request from Everyone Cooperating to Help Others, Inc. (ECHO) to conduct a fundraiser called “ECHO Ice Bowl 2005” at Traxler Park on February 12, 2005. Council Vice President Tom Wellnitz stated the Consent Agenda would be approved if there were no objections. There were none. OLD BUSINESS 1. Requests and comments from the public regarding the Agenda. By consent, Council changed the wording to “Requests and comments from the public regarding items on the agenda not requiring a public hearing.” 2. A proposed ordinance rezoning property located at 1719 West Racine Street from M1 to R2 received its third reading and second public hearing. June Kaplan, 506 South Locust Street; Ty Bollerud, 424 South Pearl Street; Glen Perry, 506 South Locust Street; and Helene Graumann, 1515 Maple Avenue, all spoke in support of the proposed ordinance. Joe Pregont, 444 Oak Road, spoke in opposition to the proposed ordinance. The public hearing was closed. Councilmember DeGarmo moved to deny said ordinance. Motion died for lack of a second. Councilmember Tim Wellnitz moved to adopt said ordinance, seconded by Councilmember Addie and passed by the following vote: Aye: Council Vice President Tom Wellnitz, Councilmembers Tim Wellnitz, Addie, Brien, and Williams. Nay: Councilmember DeGarmo. (File Ord. No. 2004-253) 3. A proposed ordinance banning the use of “Outdoor Wood Burning Furnaces” within the City Limits received its second reading and public hearing. Steve Hovland, 1501 Parker Court; Matthew Wixom, 424 South Pearl Street; Ty Bollerud, 424 South Pearl Street, Chris Ranum, 715 Grove Street; Ed Olson, 588 State Road 73, Edgerton; and Jane Starks, 588 State Road 73, Edgerton all spoke in opposition to the proposed ordinance. Dan Bilz, 4529 Plantation Lane and Howard Wagner, 4521 Plantation Lane spoke in support of the proposed ordinance. The public hearing was closed. Councilmember Williams moved to adopt said ordinance, seconded by Councilmember DeGarmo and passed unanimously. (File Ord. No. 2005-256) 4. City Manager’s Report. A) Worthless Checks Program. Wald Klimczyk, City Attorney, gave a presentation on the City Attorney’s role in recovering money for businesses from worthless checks. Since the ordinance was first enacted in 1982, $1,430,000 has been recovered. NEW BUSINESS 1. A proposed resolution authorizing the City of Janesville to accept a Wisconsin Department of Natural Resources Grant for the purpose of Goose Management. Councilmember DeGarmo moved to adopt said resolution, seconded by Councilmember Addie and passed unanimously. (File Res. No. 2005-133) 2. A proposed resolution vacating a portion of Hoya Lane and Old Kennedy Road north of Terapin Trail was introduced and scheduled for public hearing on March 14, 2005. (File Res. No. 2005-135) 3. Requests and comments from the public on matters which can be affected by Council action. Richard Frank, 1119 Elida Street; spoke regarding property rights guaranteed by Constitutional Amendments. Ty Bollerud, 424 South Pearl Street; spoke regarding housing issues. 4. Matters not on the Agenda. By consent Council agreed to require the public to sign up prior to speaking on “requests and comments from the public regarding the agenda” and “requests and comments from the public on matters which can be affected by Council action” but not for agenda items with public hearings.
