RESOLUTION NO. 2005-129
A resolution releasing a portion of a sanitary sewer and utility easement located along the north
line of Lots 387 and 388 of the Fourteenth Additions to Fox Ridge Estates Subdivision.
WHEREAS, a fourteen (14) foot wide utility easement was dedicated by separate instrument and
recorded as Document No. 1307411 on September 19, 1996 and as referenced on the northerly line of
Lots 387 and 388 of Fox Ridge Estates 14th Addition Subdivision recorded on March 2,2004, Volume
32 of Plats, Page 626, Document No. 1653477 in the office of the Register of Deeds for Rock County,
Wisconsin.
WHEREAS, the south 1.5 feet of said easement has not been used for municipal facilities and is no
longer needed for public utility purposes; and
WHEREAS, the City Council finds that the release of said portion of the existing sanitary sewer and
utility easement will not be contrary to the public interest.
NOW, THEREFORE, BE IT RESOLVED that a portion of the easement as described below shall be
released:
Located in the NW 14 of the SW 14 of Section 16, T.3N., R.13E. of the 4th P.M., City of
Janesville, Rock County, Wisconsin described as follows:
The south 1.5 feet ofa 14-foot wide sanitary sewer and utility easement located on the north line
of Lots 387 and 388 in Fox Ridge Estates 14th Addition Subdivision recorded on March 2,2004,
Volume 32 of Plats, Page 262, Document No. 1653477 in the office of the Register of Deeds for
Rock County, Wisconsin.
BE IT FURTHER RESOLVED THAT upon adoption of this resolution, the City Clerk is directed to
record a certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus
granting the easement release as herein described.
