RESOLUTION 2004 112
A Resolution Authorizing the Administration to File a Local Appeal for an
Exemption from State Mandates under the Provisions of Section 66.0143 of Wisconsin Statutes
For an Extension of the Expenditure Period in TIF No. 16
WHEREAS, the Common Council of the City of Janesville created Tax Increment Finance (TIP)
District by adoption Resolution 96-2100 on September 9, 1996 in order to stimulate the economic
development of the property within this TIP district; and
WHEREAS, the seven (7) year period for making TIP expenditures under the provisions of Section
66.1105 (6) (am) 1. of Wisconsin Statutes expired on July 8,2003; and
WHEREAS, the provisions of2003 Wisconsin Act 126 intended to extend the expenditure period for
existing TIP districts to a maximum of eighteen (18) years, but failed to do so because of a legislative
drafting error; and
WHEREAS, the City of Janesville relied upon the provisions of2003 Wisconsin Act 126 extending the
TIP expenditure period in negotiating a TIP Agreement with Lowe's Home Centers in support of a
Millwork Manufacturing Plant that will employ 90 persons and result in new capital expenditures in
excess of$4.0 million; and
WHEREAS, the Wisconsin Department of Revenue has the authority to grant an exemption from a
State Mandate under the provisions of Section 66.0143 of Wisconsin Statutes and permit the extension
of the expenditure period for existing TIP Districts;, and
WHEREAS, obtaining a State Mandate exemption to extend the expenditure period in TIP No. 16 will
allow the completion of the Lowe's Millwork Manufacturing Plant project that will create 90 new jobs
and result in a $4.0 million capital investment in TIP No. 16; and
WHEREAS, the granting of an exemption from a State Mandate under the provisions of Wisconsin
Statutes 66.0143 extending the expenditure period for TIP No. 16 will further the City of Janesville's
efforts to promote economic development within TIP No. 16 and will not negatively affect the health
and safety of the community; and
WHEREAS, requesting a State Mandate exemption is in the best interests of the City of Janesville and
its citizens;
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Janesville that it
hereby authorizes and directs the City Manager to file a local appeal for an exemption from State
mandates under the provisions of Section 66.0143 of Wisconsin Statutes to extend the expenditure
period for City of Janesville TIP No. 16;
BE IT FURTHER RESOLVED, that the City Manager is authorized, from time-to-time, to draft, enter
into and take, on behalf of the City of Janesville such forms, documents, agreements, transactions and
actions that the City Manager determines to be necessary or desirable to effectuate the granting of said
State Mandate exemption.
