2019-1669 FILE RESOLUTION NO. 2019-1669 A proposed resolution urging passage of Wisconsin 2019 Assembly Bill 177 relating to local regulation of certain containers. WHEREAS, the State of Wisconsin has a long history of supporting strong local government as the entities closest to the people served; and WHEREAS, Wisconsin Statute § 66.0419 currently prohibits local governments from regulating the use, disposition, or sale of auxiliary containers; and WHEREAS, auxiliary containers are defined in Wis. Stat. § 66.0419 as "a bag, cup, bottle, can, or other packaging that is designed to be reusable or single-use; that is made of cloth, paper, plastic, cardboard, corrugated material, aluminum, glass, postconsumer recycled material, or similar material or substrates, including coated, laminated, or multi-layer substrates; and that is designed for transporting or protecting merchandise, food, or beverages from a food service or retail facility"; and WHEREAS, Wisconsin is one of just 13 states with existing legislation that preempts local government control over auxiliary containers; and WHEREAS, Wisconsin 2019 Assembly Bill 177 would repeal Wis. Stat. § 66.0419, thereby allowing local governments to locally regulate the use, disposition, and sale of auxiliary containers; and WHEREAS, policy decisions should be made at the level of government closest to the people when the matter is not of statewide concern. NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Janesville does hereby urge the Governor and Legislature to protect local control by passage of Wisconsin 2019 Assembly Bill 177 relating to local regulation of certain containers; and BE IT FURTHER RESOLVED, that the Common Council directs the City Clerk-Treasurer to send a copy of this resolution to Governor Evers and the City of Janesville's legislative delegation.
