2019-1663 RESOLUTION NO. 2019-1663 A resolution to release and relocate a utility easement on property located at t316-I512 Huntington Avenue. 3910-3912 WHEREAS, two six-foot wide utility easements were dedicated on Lot 9, Huntington Place; as recorded in Volume 32, Page 514 of Plats of Rock County, Wisconsin; and WHEREAS, the owner of said property requests that the City relocate the utility easements to allow for construction of a two-unit condominium; and WHEREAS, the owner of said property requests that the City release its rights and interests in the easement areas; and WHEREAS, there are no existing public utilities located within said easements; and WHEREAS, the Plan Commission reviewed and found the proposed release and relocation of said utility easements to be consistent with City plans; and WHEREAS, the City Council finds the release of existing easements consistent with the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City of Janesville hereby releases to the following described easement: Located in the NW corner of Section 16, T.3N, R.12E of the 4th P.M. of the City of Janesville, Rock County, Wisconsin described as follows: All that part of two 6 foot utility easements located on Lot 9, Huntington Place, City of Janesville, Rock County, Wisconsin, excepting the south 10 feet thereof. BE IT FURTHER RESOLVED that the City of Janesville accepts placement of the following described easement to the owner of the subject property: Located in the NW corner of Section 16, T.3N, R.12E of the 4th P.M. of the City of Janesville, Rock County, Wisconsin described as follows: Over that part of Lot 9, Huntington Place (now being part of Huntington Place Condominiums), City of Janesville, Rock County, Wisconsin; and commencing at the NE Corner of said Lot; thence N66°56'20"W along the North Line of said Lot, 102.0 feet; thence S23°03'40"W 110.0 feet; thence N66°56'30"W 12.0 feet; thence N23°03'40" E 110.0 feet to said North Line; thence S66°56'20"E 12.0 feet to the place of beginning. BE IT FURTHER RESOLVED that said easement release by the City of Janesville does not relinquish any inherent rights that other utility companies serving the area may have to use said easement. RESOLUTION NO. 2019-1663 PAGE 2 BE IT FURTHER RESOLVED that upon adoption of this resolution, the City Clerk is directed to record a certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus granting the easement release as herein described.
