CP047 (Review of Redevelopment Projects)CITY OF JANESVILLE Policy No. 47 Page 1 of 2 CITY COUNCIL POLICY STATEMENT Date Issued 8/10/81 Revised 6/10/2019 General Subject: Administration Effective Date 6/10/19 Specific Subject: Review of Redevelopment Projects Cancellation Date Supersedes No. Responsible Dept/Div: Economic Development Office PURPOSE To establish a procedure for review of redevelopment projects which require participation by the City including the acquisition of property for resale to a developer. STATEMENT OF POLICY The following procedure shall be utilized to evaluate a redevelopment project: 1. A developer who approaches the City Administration to discuss a potential redevelopment project shall indicate what assistance from the City will be needed to implement the project. If the assistance is financial, the developer shall indicate the amount of financial assistance required of the City to make the project economically feasible. 2. The City Administration shall evaluate the proposed project. This analysis of the project shall include: 1) the impact of the project upon the community and neighborhood; 2) relationship to Comprehensive Plan and TIF Project Plan; 3) consistency with City development regulations; 4) a determination of probable property tax increment generated; 5) identification of relocation needs; and 6) anticipated costs of preparing the land for redevelopment purposes. The City may obtain an independent appraisal of the property. 3. At this point, the City and the developer may decide whether the probability of the project being completed warrants presenting the proposal to the City Council and preparation and submission of any necessary relocation plan. It is recognized that such preliminary negotiations are subject to City Council review and approval. 4. The Administration will then compile the necessary information to be presented to the City Council for review. 5. A preliminary review by the City Council of the proposed redevelopment project shall take place in closed session pursuant to Section 19.85 (1) (e) of Wisconsin State Statutes. The Council shall consider the Administration’s report and evaluate: 1) the benefit of the project to the community; 2) the purchase or sale of property by the City; and 3) the amount and appropriateness of any assistance including the amount of property acquisition “write-down” requested by the developer. 6. The Economic Development Office shall provide the City Council a report regarding the proposed project. The report shall address the conformance of the project to adopted objectives or redevelopment plans. The scope of review should include an evaluation of the probable property tax increment generated by the project and identify positive and negative aspects of the proposed redevelopment project, but shall not include an evaluation of the financial involvement by the City as this is the sole responsibility of the City Council. The City Council shall direct the Administration on how to proceed on the project. If authorized by the City Council, the Administration shall finalize negotiations. 8. If agreement is reached, the matter will be placed on a subsequent agenda for a City Council meeting. Information pertinent to the project will be made available to the public at this Council meeting. W hen the project involves acquisition of property by the City, the matter will be referred to the Plan Commission for a report and recommendation. 9. The Plan Commission review of the project shall be a report in conformance with Section 62.23(5) of Wisconsin State Statutes and Chapter 18 of the Code of Ordinances of the City of Janesville, if required. It is the responsibility of the Plan Commission to evaluate the project for its conformance with the City’s Master Plan and other adopted plans. It is the responsibility of the City Council and not the responsibility of the Plan Commission to evaluate any potential financial involvement by the City. 10. The final review by the City Council of the final proposed project shall take place in an open session. The Council will consider the proposed project, the report of the Economic Development Office, and the recommendation of the Plan Commission. By motion, Council shall approve or disapprove the proposed redevelopment project including any assistance of financial involvement by the City. 11. The Administration then implements the action authorized by the City Council.
