2004-90 RESOLUTION NO. 2004 - 90 A resolution authorizing a mutual aid hazardous materials response services intergovernmental agreement hetween the Ci(V of Janesville and the County of Rock. WHEREAS, the County of Rock desires to provide fiscal resources as specified in Section 4.01 of a certain County of Rock and City of Janesville Agreement for HAZMAT Response Services (the "Agreement") a true and correct photocopy of which Agreement is attached hereto and incorporated herein by reference as if fully set forth verbatim; and WHEREAS the Agreement is enabled, encouraged and in accord with §66.0301, Wis. Stats., (2001-2002) authorizing intergovernmental cooperation, and pursuant to the Rock County HAZMAT Emergency Response Plan, in order to enhance the regional use of the Janesville HAZMA T Response Team by Rock County; and WHEREAS the terms of the HAZMA T Response Services Agreement are structured such that it is cost neutral to the City of Janesville; and WHEREAS the City of Janesville is able and willing to provide such services to the County of Rock and the Agreement enables the City to provide HAZMA T Team services to Fire Districts throughout Rock County; and WHEREAS, such services shall be for limited initial emergency response to hazardous substance releases and shall include response information, training, and emergency planning, all in accordance with the Plan and related Pact upon the call for assistance dispatched by the Rock County Communications Center; and WHEREAS, the Rock County HAZMA T Emergency Response Plan (hereinafter the "Plan") is mandated by and in accord with § 166.03, Wis. Stats., (2001-2002), which requires the documentation of hazardous substance information, and the conduct emergency planning as set forth in § 166.20, Wis. Stats.; and WHEREAS, the authority is granted to local agencies to respond to hazardous substance discharges in §166.22, Wis. Stats., (2001-2002); and WHEREAS, the Common Council find such Agreement, the City's participation and County aid all to be in the best public interest and for the benefit of the City, its residents, businesses, and surrounding communities. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville that the City enter into the Agreement forthwith. BE IT FURTHER RESOL VED that the City Administration and Janesville Fire Department enter into, on behalf of the City of Janesville, the attached Agreement with the County of Rock in the manner and upon the terms, conditions, and provisions set forth in the attachments hereto.
