2019-1632 RESOLUTION NO. 2019-1632
A resolution vacating a portion of Wall Street west of Academy Street.
WHEREAS, a portion of Wall Street west of Academy Street hereinafter designated and
previously dedicated for right-of-way purposes is hereby determined to be no longer needed for
public use, and therefore, the public interest requires the vacation of such street portion; and
WHEREAS, owners of the adjoining property to the south desire to combine the right-of-way to
their property for the development of parking and additional green area along Centerway; and
WHEREAS, it has been determined that the traffic flow will not be impeded by the vacation of
such street portion; and
WHEREAS, the proposed street vacation has been referred to the Plan Commission for its
consideration and report as required by 62.23(5), Wisconsin State Statutes; and
WHEREAS, a public hearing was held on vacation of such street portion and notice required by
Wisconsin Statutes 66.1003 has been timely published and served; and
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JANESVILLE that the following described street portion be and is hereby vacated and
discontinued pursuant to 66.1003 and 62.22(Im), Wisconsin Statutes:
Part of West Wall Street, located in part of the Northwest 1/4 of Section 36, T.3N., R.12E., City of
Janesville, Rock County, Wisconsin, more particularly described as follows:
Beginning at the Northeasterly corner of Lot 18 of Willard's Subdivision of Lot No. One of
Mitchell's Addition; thence South 61°19'29" West, 187.01 feet, more or less, along the Northerly
lines of Lots 18 and 19 of said Willard's Subdivision of Lot No. One of Mitchell's Addition (also
being the Southerly line of West Wall Street) to a point that is 40 feet Southeasterly and normal
to the centerline of U.S.H. "51" as shown on Plat of Right-of-Way required for Project ID No. U
4907(1); thence parallel with aforesaid centerline, 94.16 feet, more or less, along the arc of
curve to the right having a radius of 294.00 feet and a chord which bears North 42°41'50" East,
93.76 feet, more or less; thence continue, North 51°52'22" East, 99.72 feet more or less, to the
Northerly extension of the Westerly right-of-way of North Academy Street; thence South
28°24'55" East, 46.32 feet, more or less, to the place of beginning. Containing 5,312 s.f. of
land, more or less.
NOW THEREFORE BE IT FURTHER RESOLVED that the City of Janesville hereby retains a
blanket easement for utility purposes over the entire land area herein described.
