RESOLUTION NO. 2004-86
A resolution amending the conditions of approval for Ordinance No. 2003-208 restricting
the use of 2843 Holiday Drive to fourteen residential units.
WHEREAS, on February 23, 2004, the Common Council of the City of Janesville approved
Ordinance No. 2003-208 which approved a rezoning for a portion of property within the 2700-
2800 block of Holiday Drive from R3 to B4 and as a condition of approval of the Ordinance, the
Council restricted use of the remainder of the undeveloped multiple family parcel at 2843
Holiday Drive to fourteen residential units; and
WHEREAS, the condition was included based upon a preliminary design for the property and
more detailed designs now show that the property can adequately accommodate fifteen
residential units on the site; and
WHEREAS, the Plan Commission at its September 20, 2004 meeting voted to amend the
development restriction to allow fifteen residential units on the property addressed as 2843
Holiday Drive and to approve a fifteen-unit Planned Unit Development for the site.
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY
OF JANESVILLE that the development restriction of fourteen residential dwelling units on the
following described property be amended to permit a total of fifteen residential dwelling units as
approved by the Plan Commission on September 20, 2004 through the review of a Planned Unit
Development for the site and the existing deed restriction for the property be modified to reflect
that a total of fifteen units may be developed on the following described property:
LOT 4 OF CERTIFIED SURVEY MAP RECORDED MAY 12,2004 IN VOL. 27 OF
CERTIFIED SURVEY MAPS, PAGES 136-142, DOCUMENT NUMBER 1663149 OF THE
ROCK COUNTY REGISTER OF DEEDS OFFICE, ROCK COUNTY, WISCONSIN.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to take whatever
other actions or to make whatever other minor changes that may be necessary to effectuate the
intent of this Resolution.
