RESOLUTION NO. 2004-80
A resolution authorizing the City Manager to proceed with the sale of surplus
property located at 2025 Beloit Avenue.
WHEREAS, the City of Janesville owns the following described parcel:
Part of the NW ~ of the SW ~ of Section 7, T.2N., R13E., City of Janesville, Rock
County, Wisconsin, described as follows: Commencing at the West Quarter corner of
said Section 7; thence S.0024'50" E., on a true bearing along the West line of the SW ~
of said Section, 274.66 feet to an iron pipe monument set at the place of beginning for
the land to be herein described; thence N.89°E., as measured at right angles to said
West line, 386.03 feet to an iron pipe monument set on the Southwesterly RO.W. (right
of way) line of the Chicago and Northwestern Railroad; thence S.38°02'35" E., along
said Southwesterly RO.W. line 129.17 feet to an iron pipe monument; thence S.89°W.,
parallel with the first described line, 464.89 feet to an iron pipe monument set on the
West line of the SW ~ of Section 7, aforesaid; thence N.0024'50" W., along said West
line 102.30 feet to an iron pipe monument at the place of beginning.
Except the following: That part of the Northwest 1/4 of the Southwest 1/4 of Section 7,
in Town 2 North, Range 13 East, in the City of Janesville, County of Rock, State of
Wisconsin, bounded and described as follows:
Commencing at the West 1/4 corner of said Section 7; thence South 00°26'41" East,
374.32 feet along the West line of the Southwest 1/4 of said Section 7 to the North line of
the owner and point of beginning; thence North 89°33'19" East, 45.00 feet along said
North line; thence South 00°26'41" East, 102.40 feet to the owners South line; thence
South 89°33'19" West, 45.00 feet along said South line to the West line of the Southwest
1/4 of said Section 7 and West line of the owner; thence North 00°26'41" West, 102.40
feet along the said West line to the point of beginning.
WHEREAS, the property consists of approximately 0.89 acres of land located at 2025
Beloit Avenue and was purchased to facilitate the Beloit Avenue road widening project;
WHEREAS, the City will retain the necessary right-of-way along Beloit Avenue for the
road widening project, however, the remaining parcel which is developed with
commercial buildings and is zoned B3, General Commercial, is not necessary for City
purposes and has been determined to be surplus property appropriate for sale; and
WHEREAS, the Plan Commission has reviewed this at its meeting held on 7 September
2004 and found the sale consistent with city plans and recommended that the City
Council proceed with the sale of this property, but further noted that the Plan
Commission has not reviewed the financial aspects of this transaction; and
WHEREBY, the Common Council of the City of Janesville does hereby find that this
property is surplus and is no longer needed for City purposes and that the proposed
transaction is to the benefit and the best interest of the citizens and the City of
Janesville.

NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL of the City of
Janesville that it hereby authorizes and directs the City Manager and the City Clerk to
negotiate, enter into and execute, on behalf of the City of Janesville, the sale of such
property; and to negotiate and execute such documents, papers and forms as may from
time to time be necessary and/or desirable to effectuate such transaction and the intent
of this resolution as the City Manager may decide; and
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to take
whatever other actions or to make whatever other minor changes that may be
necessary to effectuate this land transaction.
