2018-731 ORDINANCE NO. 2018-731 An ordinance annexing territory located in Section 3, T.2N., R.12E. of the 4th P.M., Rock Township, Rock County, Wisconsin. WHEREAS, a petition signed by the owners of one-half of the land within such territory proposed to be annexed has been filed with the City Clerk; and WHEREAS, there are no electors residing in the territory; and WHEREAS, the necessary notices have been duly prepared, provided and served as required by law to all persons affected; and WHEREAS, this ordinance does not contain temporary zoning; and WHEREAS, the Department of Administration has not found the proposed annexation to be against the public interest; and WHEREAS, the Common Council has determined that this annexation is in the public interest. NOW THEREFORE THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The territory described as follows is hereby attached to the City of Janesville. PART OF GOVERNMENT LOT 1 AND PART OF GOVERNMENT LOT 2 OF FRACTIONAL SECTION 3, T. 2 N., R. 12 E. OF THE 4TH P.M., TOWN OF ROCK, ROCK COUNTY, WISCONSIN. DESCRIBED AS FOLLOWS: Beginning at the intersection of the Southeasterly curving right of way line of Afton (C.T.H. "D") Road with the Southerly line of Government Lot 2 of aforesaid Section 3, said point being 3306.25 feet North 66°31'15" East of the Southwest corner of said Section; thence 1382.68 feet along said curving right of way line to the right, having a radius of 4533.66 feet and a chord of North 40°06'39" East, 1377.32 feet; thence South 1°25'44" East 231.58 feet parallel with the West line of said Government Lot 2 to the intersection with the Northwesterly right of way line of the former C. M. St. P. & P. Railroad; thence North 50°53'53" East 1821.74 feet more or less to the East line of said Section 3; thence South 1°20'47" East 83.48 feet along said East line to the intersection with the Southeasterly right of way line of said railroad; thence South 50°53'53" West 1894.97 feet more or less along said Southeasterly right of way line to a point of curve; thence Southwesterly 593.31 feet along a curve to the left, having a radius of 1430.33 feet with a chord of South 39°00'53" West 589.07 feet; thence continuing along said right of way line, South 27°07'53" West 263.07 feet more or less to the intersection with the Southerly line of said Government Lot 2; thence South 89°56' West 347.47 feet along said Southerly line as fenced to the place of beginning. Containing 9.28 acres more or less SECTION II. After this annexation becomes effective, the above described property shall be exempt from and not subject to further taxation and assessments in the Town of Rock and thence forth shall be subject to taxation and assessment as part of the City of Janesville for any and all purpose provided by law. ORDINANCE NO. 2018-731 PAGE 2 SECTION III. All the territory attached by this ordinance is hereby made part of Ward 32 of the City of Janesville. SECTION IV. There are no residents in the area proposed for annexation. SECTION V. The annexation is within the School District of Janesville. SECTION VI. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
