2004-58RESOLUTION NO. 2004-058
A Resolution Regarding the Taxpayers Bill of Rights (TABOR).
WHEREAS, the current proposed TABOR Amendment requires elector approval for
certain taxing, spending, and bonding decisions by the state and certain local
governmental units, such as exceeding a spending limit or imposing new taxes, increasing
tax rates, extending expiring taxes, or making tax changes causing net revenue gains;
requires that emergency taxes imposed by the state meet certain conditions; requires
governmental units to establish a budget stabilization fund; and requires governmental
units to refund amounts in excess of the approved amounts and reduce revenues to reflect
excess of revenues over expenditures; and
WHEREAS, a proposed Constitutional Amendment requires adoption by two successive
legislatures and ratification be the people before it can become effective; and
WHEREAS, government spending will be limited to the Consumer Price Index (CPI)
plus population growth, new construction and increased enrollment for schools; and
WHEREAS, the TABOR Amendment mirrors that passed in Colorado in 1992 which the
state has found far too constrictive, having had to cut important services, and is currently
trying to re-amend to suit the needs of its normal fluctuating economy; and
WHEREAS, the current proposed TABOR Amendment to Wisconsin's Constitution
fails to exclude TIF levy limiting community growth as fostering economic development
will no longer be a priority; and
WHEREAS, the current proposed TABOR Amendment to Wisconsin's Constitution
fails to exclude debt payments increasing the cost of the debt to the municipality because
that debt would be less secure for investors; and
NOW, THEREFORE, LET IT BE RESOLVED by the Common Council of the City
of Janesville that the Common Council be in opposition to the current State
Constitutional Amendment concerning TABOR.
