2018-724 ORDINANCE NO. 2018-724 An ordinance permitting and regulating sandwich board signs in Downtown Sign District D by creating JGO Sections 14.08.255 and 14.24.135, with penalties for violations thereof, together with injunctive relief and remedies upon default of forfeiture payment as set forth in JGO Chapter 14.48. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 14.08.255 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "14.08.255 Sandwich Board Sign. A sandwich board sign is an outdoor, freestanding sign consisting of 2 sign faces hinged together. A sandwich board sign does not include other portable signs. A sandwich board sign must exclusively refer to a business, person, activity, product, service or price located on the premises immediately adjacent to the public sidewalk or private property where the sign is located or used. Upon a public sidewalk, use is permitted only upon that portion of the sidewalk immediately in front of the referred-to business property." SECTION II. Section 14.24.135 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "14.24.135 Sandwich Board Sign. A. Sandwich board signs are regulated exclusively by this section. Sandwich board signs must comply with each of the following requirements and conditions: 1. Require a sign permit. The permit fee is $60.00 annually and must be paid in full to the Building Division prior to the use of the sign. This fee shall not be prorated. 2. Is permitted on the public pedestrian right-of-way (or public sidewalk) (a) immediately in front of the business occupancy to which it refers, and (b) only in Sign District D only (Downtown). Such signs located in all other sign districts shall be placed solely on private property in accordance with JGO Section 14.20.040. 3. Must not obstruct or impede, or permit the obstruction or impeding, of use of the "pedestrian right-of-way" on any public sidewalk. A "pedestrian right-of- way," for the purposes of this ordinance, shall mean an unobstructed area of a minimum of five contiguous feet (5') in width measured in a straight line at right angles from the building and running the length of the property line. 4. Must be removed each day at the close of business until the normal opening of the business the next day, but in no event later than 11:00 o'clock P.M. or before 6:00 o'clock A.M. respectively, each day. 5. Must not exceed 8 square feet in the sign area per sign face, or a total of 16 square feet for two sign faces. 6. Must not exceed 4 feet in height. 7. Must not exceed one in number per business establishment. 8. Must be set back a minimum of 2 feet from the curb. 9. Will not be counted in calculating the total allowable sign area on the sign owner's premises. 10.Must not be an off-premises sign. 11.Must be freestanding, contain 2 sign faces, and be hinged together at all times 12.A sandwich board sign does not include other portable signs 13.A sandwich board sign must exclusively refer to a business, person, activity, product, service, or price located on the premises immediately adjacent to the public sidewalk or private property where the sign is located or used. 14.Upon a public sidewalk, use is permitted only upon that portion of the sidewalk immediately adjacent to the referred-to business property." SECTION II. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
