2004-24RESOLUTION NO. 2004-24 A resolution vacating a portion of Wall Street east of Academy Street. WHEREAS, a portion of Wall Street east of Academy Street hereinafter designated and previously dedicated for right-of-way purposes is hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street portion; and WHEREAS, the portion of Wall Street to the east has previously been vacated to facilitate the redevelopment of the property to the east and vacation of this portion will allow expansion of the parking lot to be constructed in the previously vacated portion; and WHEREAS, the proposed street vacation has been referred to the Plan Commission for its consideration and report as required by 62.23(5), Wisconsin Statutes; and WHEREAS, a public hearing was held on the vacation of such street portion and notice required by Wisconsin Statutes 66.296 has been timely published and served. NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described street portion be and is hereby vacated and discontinued pursuant to 66.296 and 66.22(lm), Wisconsin Statutes: Part of the SW ¼ of the NW ¼ of Section 36 T.3N., R.12E. of the 4th P.M., City of Janesville, Rock County, Wisconsin. DESCRIBED AS FOLLOWS: Beginning at the westernmost comer of Lot 20 of Doe's Subdivision, a recorded plat; thence northeasterly along the north line of said Lot 20 ! ! 9.85 feet to the northern most comer of said Lot 20, thence continuing along the same line 14 feet to the westernmost comer of Lot 14 of Doe's Subdivision, thence northwesterly and perpendicular to the south right-of-way-line of West Wall Street, 66 feet to the north right-of-way line; thence southwesterly along the north right-of-way line, 133.85 feet to a point; thence southeasterly and perpendicular to the north right-of-way line of West Wall Street, 66 feet to the westernmost comer of said Lot 20 which is the point of beginning, except those portions located within 40 feet of the centerline of Centerway. NOW THEREFORE BE IT FURTHER RESOLVED that the City of Janesville hereby retains an easement for utility purposes 15 feet in width on either side of the centerline of the portion of Wall Street proposed for vacation.
