2018-1503 RESOLUTION NO. 2018-1503
A resolution vacating a perpetual easement for street purposes (JATCO Drive) located
between South Jackson Street and the Chicago Northwestern Underpass; and creating a
perpetual easement for street purposes located at the northwest corner of JATCO Drive
and South Jackson Street.
WHEREAS, a perpetual easement for street purposes (JATCO Drive) located between South
Jackson Street and the Chicago Northwestern Underpass; and a perpetual easement for street
purposes located at the northwest corner of JATCO Drive and South Jackson Street are hereby
determined to be no longer needed for public use, and therefore, the public interest requires the
vacation of such easements; and
WHEREAS, it has been determined that traffic flow will not be impeded by the vacation; and
WHEREAS, the proposed vacation has been referred to the Plan Commission for its
consideration and report as required by 62.23(5), Wisconsin State Statutes; and
WHEREAS, the public hearing was held on vacation of such perpetual easements for street
purposes and notice required by Wisconsin Statutes 66.1003 has been timely published and
served; and
WHEREAS, the Common Council finds the vacation of perpetual street easements in the best
interest of the community and its residents and businesses;
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JANESVILLE that the following described perpetual easements for street purposes be and are
hereby vacated and discontinued pursuant to 66.1003 and 62.22(Im), Wisconsin Statutes:
Both easements located within the SE1/4 of Section 1, T.2N., R.12E. of the 4th P.M., Town of
Rock, Rock County, Wisconsin described as follows:
Easement A — Perpetual Easement for Street Purposes (JATCO Drive)
A perpetual easement for street purposes in and to the following described property: Part of Lot
Three hundred twenty nine (329) in Spring Brook Addition to the City of Janesville, Rock
County, Wisconsin described as follows: Commencing at an iron pipe monument at the
intersection of the Northerly line of George Place with the Westerly line of South Jackson Street
in said City and running thence due South along the Westerly line of said South Jackson Street
three hundred forty one and ninety five one-hundredths (341.95) feet to an iron pipe monument
for the point of beginning: Thence Southwesterly along a circular arc, the radius of which is
eighty four and eighty four one-hundredths (84.84) feet and the tangent of which is forty and no
one-hundredths (40.00) feet, said arc having a central angle of fifty degrees and twenty nine
minutes (50°-29'), and a length of seventy four and seventy five one-hundredths (74.75) feet
ending at an iron pipe monument; thence South fifty degrees twenty nine minutes West (S.50°-
29'W.) to the Northeasterly line of the right of way of the Chicago and Northwestern Railway
Company; thence Southeasterly along the Northeasterly line of said railway right of way seventy
and no one-hundredths (70.00) feet; thence North fifty degrees twenty nine minutes East
(N.50o-29' E.) to the Westerly line of said South Jackson Street; thence due North one hundred
thirty and seventy four one-hundredths (130.74) feet to the place of beginning, the intent of this
deed being to convey for street purposes a strip of land seventy and no one-hundredths (70.00)
feet in width extending from said South Jackson Street southwesterly in a direct line to an
underpass beneath said Chicago and Northwestern Railway Company's tracks, said strip of
land being centered upon the center line of said underpass and said center line extended
northeasterly; together with the area included between the limits of said strip, said South
Jackson Street and said curve described above.
Easement B - Perpetual Easement on north end adloininq JATCO & South Jackson:
A perpetual easement for street purposes over a part of Lot 329 of Spring Brook Addition, in the
City of Janesville, Rock County, Wisconsin, to-wit: Beginning at the point of intersection of the
southerly right-of-way line of the Chicago and Northwestern Railway Belt Line with the westerly
line of South Jackson Street and running thence southerly along the westerly line of said South
Jackson Street 18.95 feet to a point of curve; thence southwesterly along the curvilinear right-of-
way line of the northerly side of JATCO Drive to its point of intersection with a line that is 18 feet
westerly from and parallel to the original westerly line of said South Jackson Street; thence
northerly and parallel to the original westerly line of said South Jackson Street and 18 feet
westerly therefrom to the point of intersection with the southerly right-of-way line of said railway
belt line; thence easterly along the southerly right-of-way line of said railway belt line to the
place of beginning.
NOW THEREFORE BE IT FURTHER RESOLVED that the City of Janesville hereby retains a
blanket perpetual easement for utility purposes over the entire land area described as
Easement A (JATCO Drive).
