2018-1493 RESOLUTION NO. 2018-1493
A proposed resolution to support a grant request to the Wisconsin Department of Natural
Resources for funding through the 2018 Stewardship - Urban Rivers Program and Land
and Water Conservation Fund (LAWCON).
WHEREAS, a 2012 inspection of the Monterey Dam identified structural deficiencies the
Wisconsin Department of Natural Resources required the City to correct; and
WHEREAS, the City studied repair and removal options and conducted an exhaustive public
engagement process; and
WHEREAS, the Janesville City Council voted to remove the Monterey Dam, which will cause
the Rock River water level to drop upriver in the vicinity of Monterey Park; and
WHEREAS, the removal of Monterey Dam presents an opportunity to make improvements to
the Rock River corridor to improve water quality, wildlife habitat, and water based recreation;
and
WHEREAS, the City of Janesville adopted the Janesville Park and Open Space Plan in October
2016, which calls for preserving the City's and region's natural resources and amenities for the
benefit of current and future residents; and
WHEREAS, the Janesville Park and Open Space Plan recommends that if the Monterey Dam is
removed, waterway rehabilitation measures should emphasize public safety and enhancement
of water recreation opportunities such as fishing, nature observation and hiking; and
WHEREAS, the proposed plans to restore the north shoreline and add recreational amenities to
Monterey Park are consistent with the Janesville Park and Open Space Plan; and
WHEREAS, the State of Wisconsin Department of Natural Resources (WDNR) is currently
soliciting grant applications for assistance in constructing improvements that provide additional
recreation opportunities to area residents, improve the quality of public lands and waterways,
and increase access to and use of public waterways; and
WHEREAS, the State share for such a project may not exceed fifty percent (50%) of the total
eligible project costs under the Stewardship Grant Program and LAWCON Program; and
WHEREAS, the City will utilize Stormwater Utility funds to satisfy the local match to the
improvements proposed; and
WHEREAS, financial aid is required to carry out the Monterey Park Rock River improvements
as described in detail in the WDNR application.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the Common Council of the City of
Janesville that:
1. All above introductions and recitals are incorporated herein by reference as if fully set
forth verbatim; and
2. The City Manager is authorized and empowered by the City of Janesville to prepare and
submit applications to the State of Wisconsin Department of Natural Resources for any financial
aid that may be available; and
3. The City of Janesville shall take any and all necessary actions to undertake, direct, and
complete approved grant activities and comply with federal and state rules for the programs
including, but not limited to: appropriating, funding and/or providing all grant required city
matching contributions; submitting reimbursement claims along with necessary supporting
documentation within six months of project completion date; and submit signed documents as
may be required by the DNR;
BE IT FURTHER RESOLVED, that the City of Janesville shall comply with state or federal rules
for the programs to the general public during reasonable hours consistent with the type of
facility; and will obtain from the State of Wisconsin Department of Natural Resources or the
National Park Service approval in writing before any change is made in the use of the project
site.
BE IT FURTHER RESOLVED, that the City manager and his designee(s), on behalf of the City
of Janesville, is/are hereby jointly and severally authorized and empowered to negotiate, draft,
review, revise, modify, amend, execute, enter into, file, and/or record additional applications,
agreements, amendments, documents, reports, and letters of understanding concerning this
matter, and to take whatever additional other actions that the City Manager may determine in
his sole discretion, from time to time and at any time, necessary and/or desirable in the public
interest to effectuate the intent of this Resolution and/or the public good.
