CITY OF JANESVILLE
RESOLUTION NO. 2017-1478
A Resolution eliminating the sidewalk requirement along the south side of Ruger Avenue between
S. Wright Road and Wuthering Hills Drive due to topography challenges.
WHEREAS, Ruger Avenue will be reconstructed in 2019 between S. Wright Road and USH 14 to an
urban standard which accommodates pedestrian facilities; and
WHEREAS, the reconstruction of Ruger Avenue is eligible for up to 80% federal funding through the
State of Wisconsin Department of Transportation; and
WHEREAS, the Pedestrian Transportation Corridor Plan (PTCP) shows sidewalks on both sides of
Ruger Avenue but there are significant steep slopes on the south side of the road between S. Wright
Road and Wuthering Hills; and
WHEREAS, the preliminary roadway design indicates a sidewalk on the south side of street requires
steep restoration slopes at less than desirable standards and significantly impacts private property; and
WHEREAS, Chapter 17.46 of the Janesville General Ordinances — Sidewalks states the Council may
modify new sidewalk installation routes "where the sidewalk placement is not physically practical"; and
WHEREAS, Council Policy 70—Sidewalk Construction, Maintenance, and Assessments of Costs states
the City Engineer shall report topographical concerns that make the sidewalk inappropriate to construct;
and
WHEREAS, the State of Wisconsin Department of Transportation requires a resolution adopted by the
Common Council to eliminate sidewalk from the project;
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Janesville hereby
agree to eliminate the sidewalk installation requirement on the south side of Ruger Avenue between S.
Wright Road and Wuthering Hills Drive due to topographical challenges as well as to amend the PTCP to
show this segment as `orange' — unplanned, unfunded sidewalk.
