2017-1458 RESOLUTION NO. 2017-1458
A resolution vacating a Perpetual Easement for Street Purposes located between 1-39/90 and
Deerfield Drive.
WHEREAS, a Perpetual Easement for Street Purposes was granted to the City of Janesville in
1969 located east and adjoining Interstate 39/90 and west of Deerfield Drive; and
WHEREAS, there are no local plans to construct public street improvements within the
easement area and it is no longer needed for public use; and
WHEREAS, it has been determined that traffic flow will not be impeded by the vacation; and
therefore the public interest requires the vacation of such easement; and
WHEREAS, the proposed vacation has been referred to the Plan Commission for its
consideration and report as required by 62.23(5), Wisconsin State Statutes; and
WHEREAS, the public hearing was held on vacation of such Perpetual Easement for Street
Purposes and notice required by Wisconsin Statutes 66.1003 has been timely published and
served; and
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JANESVILLE that the following described Perpetual Easement for Street Purposes be and is
hereby vacated and discontinued pursuant to 66.1003 and 62.22(Im), Wisconsin Statutes:
Vacation of a Perpetual Easement for Street Purposes located in the NW 1/4 of the SE 1/4 and the
SW 1/4 of the SE 1/4 of Section 17, T3N, R13E of the 4th P.M. of the City of Janesville, Rock
County, Wisconsin lying within the following described traverse:
Commencing at a chiseled "X" at the south quarter corner of Said Section 17, City of Janesville,
Rock County, Wisconsin; Thence N 00°50'43" W, 1499.15 feet; Thence S 68°11'13" E, 255.75
feet; Thence southeasterly 69.30 feet along the arc of a curve concave to the south, having a
radius of 354.00 feet (the long chord of which bears S 64°03'48" E, 69.19 feet) to the Southeast
corner of Lot 2 in Certified Survey Map recorded as Document Number 1674141, said corner
also being the point of beginning; Thence N 31°32'41" E, along the East line of said Lot 2, 43.07
feet to the Northeast corner thereof; Thence S 51°19'06" E, 213.61 feet; Thence S 45°56'23" W,
76.16 feet; Thence northwesterly 204.14 feet along the arc of a curve concave to the south,
having a radius of 354.00 feet (the long chord of which bears N 41°56'18" W, 201.33 feet) to the
point of beginning but excluding the portion of lands contained within an area "Dedicated to the
Public" via Certified Survey Map #1361946, recorded in Volume 21, Pages 84 — 90 of Certified
Survey Maps of Rock County, Wisconsin.
This Perpetual Easement for Street Purposes contains .217 Acres, more or less.
