A Resolution Approving the Creation of a Business Improvement District (BID),
Adopting a BID Operating Plan, and Setting a BID Levy for 2018
WHEREAS, Wisconsin Statutes Section 66.1109 sets forth a procedure by which
communities may create business improvement districts (BID) to implement strategies
for the development, redevelopment, maintenance, and promotion of properties within
specifically designated areas of the community; and
WHEREAS, Downtown Janesville, Inc. has submitted a petition to create a BID in
downtown Janesville in accordance with the provisions of Wisconsin Statutes 66.1109;
and
WHEREAS, the petitioners have prepared a BID Operating Plan and proposed BID
levy; and
WHEREAS, the owners of all properties within the proposed BID were provided a copy
of the proposed BID Operating Plan (a copy of which is attached hereto) and were
notified by certified mail of a public hearing on the proposed BID; and
WHEREAS, the City Attorney has issued a legal opinion finding that the proposed BID
Operating Plan complies with the required provisions of Wisconsin State Statutes
66.1109(1)(f); and
WHEREAS, on September 5, 2017 the Plan Commission of the City of Janesville held a
public hearing on the proposed BID Boundary, BID Operating Plan, and BID levy and
has recommended the creation of the BID as so; and
WHEREAS, more than 30 days have elapsed since the date of the Plan Commission
public hearing and property owners of properties representing more than 40% of the
assessed property valuation of all property to be assessed under the proposed BID
Operating Plan have not filed a petition against the creation of the proposed BID; and
WHEREAS, the Common Council of the City of Janesville finds the creation of a BID,
the implementation of the proposed BID Operating Plan, and the setting of a BID levy
each to be in the best interests of the City of Janesville;
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of
Janesville does hereby:
1. Approve the boundaries of the Janesville Business Improvement District as set
forth in the Janesville BID Operating Plan and as delineated on the attached
boundary map.
2. Approve the 2017 BID Operating Plan.
3. Approve the 2018 BID Levy as set forth in the 2017 BID Operating Plan.
