2017-1438 FILE RESOLUTION NO. 2017-1438 A Resolution Adopting a Process for Amendments to the City of Janesville Comprehensive Plan WHEREAS, pursuant to sections 62.23(2),(3) of the Wisconsin Statutes, and other applicable statutes and provisions of law, the City of Janesville is authorized to prepare and adopt a comprehensive plan as defined in sections 66.1001(1)(a) and 66.1001(2) of the Wisconsin Statutes; and WHEREAS, the Common Council of the City of Janesville adopted and followed written procedures designed to foster public participation in every stage of the preparation of a comprehensive plan as required by section 66.1001(4)(a) of the Wisconsin Statues; and WHEREAS, the Plan Commission of the City of Janesville recommended approval of the City of Janesville Comprehensive Plan on December 1, 2008, and the City Council of the City of Janesville adopted a comprehensive plan under the authority of and procedures established by Section 66.1001 of the Wisconsin Statutes on March 9, 2009; and WHEREAS, the Plan may be amended and changed in the years following adoption, particularly in instances where the Plan is becoming irrelevant or contradictory to emerging policies or trends, or does not provide specific advice or guidance on an emerging issue; and WHEREAS, "Amendments" are generally defined as minor changes to the Plan maps or text; and WHEREAS, the Plan requires that the City Council adopt a resolution outlining public participation procedures that will be undertaken to ensure public participation in the comprehensive plan amendment process. NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Janesville hereby adopts the following procedures for Amending the Comprehensive Plan to fulfill the requirements of Section 66.1001(4)(a) of the Wisconsin Statutes: 1. The City Council, Plan Commission, Planning Services Division staff, a property owner, or a developer may complete an application for an Amendment to the Comprehensive Plan, which will be available in the Planning Services Division, and submit it to Planning Services Division staff along with the associated fee according to the City's review fee schedule. 2. The Plan Commission shall hold a public hearing on the proposed amendment(s). Following said public hearing, the Plan Commission shall make a recommendation by resolution to the City Council by majority vote of the entire Commission. 3. The City Clerk shall send a copy of the Plan Amendment to all the parties listed in Section 66.1001(4)(b) of the Wisconsin Statutes. 4. The City Clerk shall direct the publishing of a Class 1 notice, with such notice published at least 30 days prior to a City Council public hearing containing the information required by Section 66.1001(4)(d) of the Wisconsin Statutes. 5. The City Council shall hold a formal public hearing on an ordinance that would incorporate the proposed amendment(s) into the Plan. 6. Following the public hearing, the City Council shall approve or deny the ordinance adopting the Plan amendment(s). Adoption must be by a majority vote of all members. The City Council may require changes from the Plan Commission recommended version of the proposed Plan amendment(s). 7. If approved by the City Council, The City Clerk shall send a copy of the adopted ordinance and the amendment(s) to all the parties listed in Section 66.1001(4)(b) of the Wisconsin Statutes.
