2017-677 ORDINANCE NO. 2017-677 An ordinance changing the zoning classification of property bounded by Beloit Avenue, Kellogg Court, and Pierce Street from B2, Community Shopping District; B3, General Commercial District; and R1, Single-Family and Two-Family Residence District to M1, Light Industrial District, with a penalty and injunctive relief for a violation thereof as set forth in Section 18.28.010 of the Code of General Ordinances of the City of Janesville. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. The zoning classification of the following described property is hereby changed from B2, Community Shopping District; B3, General Commercial District; and R1, Single-Family and Two-Family Residence District to Ml, Light Industrial District: PART OF THE SE 1/4 OF THE NE 1/4 OF SECTION 12; ALL OR PART OF LOTS 1, 2, 3, 4, 5 AND 6, BLOCK 6, SUNDOWN ACRES AND A CERTIFIED SURVEY MAP RECORDED IN VOLUME 30, PAGES 205 THRU 207 OF CERTIFIED SURVEY MAPS OF ROCK COUNTY,WISCONSIN, AS DOCUMENT NO.1763298 AND PART OF THE NE 1/4 OF THE SE 1/4 OF SECTION 12, ALL BEING IN T.2N., R.12E. OF THE 4TH P.M., CITY OF JANESVILLE, ROCK COUNTY, WISCONSIN. DESCRIBED AS FOLLOWS: Beginning at the East 1/4 Corner of said Section; thence Southerly, along the East Line of the SE 1/4 of said Section, 560 feet, more or less to the easterly extension of the South Line of said Block 6; thence N88°55'42"W along said easterly extension, said South Line and the westerly extension of said South Line, 377 feet, more or less to the centerline of Pierce Street; thence Northerly along said centerline, 517 feet more or less to the South Line of Kellogg Avenue as platted on Sundown Acres; thence continuing Northerly 90 feet, more or less to the reference line of relocated Kellogg Avenue; thence northeasterly along said reference line, 139 feet more or less to the reference of Reuther Way; thence Southeasterly along said reference line of Reuther Way, 303 feet more or less to the centerline of Beloit Avenue; thence Southerly 48 feet more or less to the place of beginning. SECTION II. The above rezoning is subject to the following conditions: 1 . No more than one curb opening will be permitted from this property onto Pierce Avenue. Said curb opening shall be utilized for emergency purposes only and shall be in a location consistent with the approved development plans for the site. 2. Along the Pierce Street frontage of this property, installation of a permanent landscape buffer and fencing shall be installed to provide a visual screen between the industrial land use and the opposite residential district. The landscape buffer and fencing in this area shall be consistent with the approved landscaping plan for the site. No structure, parking, signage, or ORDINANCE NO. 2017-677 PAGE 2 outside storage are permitted within this area. SECTION III. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
